Treas. Treasurer: E. Stitt reported the following 5/31/12 balances in the Borough’s accounts:

Report General Fund, $173,292.94; Garbage & Refuse, $17,091.45; Liquid Fuels, $50,340.29; and Sewer Recovery, $161,761.76.

Collected Total Garbage Fees collected were $14,169.05, including $1,932.50 in delinquents. Sewer Recovery Fee collections totaled $1,391.01, including $412.50 in delinquents.
Pay Fire Motion was made by T. Newton, seconded by E. Hall, to pay the Fire Department

Dept $15,000.00 for 2012 – ayes 4, nays 0.

Street Streets: B. Beck reported painting guard rails, mowing, buying 3 manhole covers for

Work 16^th Street and dyetesting 1232 Wysocki. There’s still a problem with drainage from the Hileman driveway. It was decided to write to Kiski Township about this. Patching was done. Discussion was held regarding using tar with millings for patching. Eleven dumpsters were used for Cleanup Day. Some lawn machines are still at Bill’s Small Engine Repair for tune-ups. The tools approved at the May meeting were purchased. Vacation time was requested for June 11 to 15 and July 9-13.

Wilmot E. Artman stated that he received a call from Sharon Wilmot asking for gravel at her

Gravel end of Robbins Avenue.

Record T. Newton noted that the Borough has old records that need to be disposed of. Allegheny

Disposal Records Destruction will collect the records and dispose of them at their facility for about $150.00 or dispose of them on site for $256.00. Motion was made by T. Newton, seconded by E. Hall, to have Allegheny Records Destruction collect and dispose of the

Borough’s outdated records – ayes 4, nays 0.

The regular meeting of North Apollo Borough Council was called to order at 7:00 PM in the conference room of the municipal building presided over by President E. Burns, who led the Pledge of Allegiance.  Roll call of member.  The following members were present:  E. Burns, T. Newton & W. Campbell.  Absent were E. Barclay & E. Hall.  Also present were Mayor E. Artman, Solicitor A. Urti from Geary & Loperfito, B. Bothell from Senate Engineering, Operator B. Beck, Code Enforcement Officer Sam Ross & resident V. Shaeffer, 1506 Redwood Ave., who agreed to take the minutes of the meeting as Sec’y E. Stitt had recently succumbed to a medical issue and is temporarily off work.

Public Participation 

Ray Rusz:   Discussion took place with Ray Rusz, 2132 Stoops Court regarding the following:

1)     The dip at 19^th Street near the Honey Bear.  E. Burns advised that approval is needed from the state to take care of that.

2)     Tires are still piled up in the parking lot at Stoops Court apartments; the junk car has been removed, but the tires are still there.

3)     A piece of rusted rebar was presented that he had taken off kids in the Helen Clark Playground.

4)     Concerned about how the mowing & trimming of borough property was being performed saying mowing & trimming should be done in the same day & if the workers are too busy to do that, someone extra should be hired.

Sandra Pedatella, Melwood Road, Leechburg was interested in applying for a part-time secretary’s position & presented her resume.

Kim Zelonka, 2148 Stoops Ct., was interested also in a part-time secretary’s position.

Delia Fulton:  Discussion took place with Dalia Fulton, 1816 Moore Ave., concerning 1820 Moore Ave, a grey apartment building that is falling apart.  The grass is not cut & a snake was seen there.  Also, the police have been called there.  The property is owned by Bremar Real Estate.  S. Ross said he has dealt with him before.  A. Urti advised S. Ross to determine violations & report back.

Walter Keeley:  Discussion took place with Walter Keeley, 507 13^th Street, regarding the following:

1)      Soot from a fire that AJ Tire had set, blew onto his property & covered his vehicle.

2)     The conditions at 1307 Robbins Ave.  He was advised that papers have been filed with the court.

3)     At 13^th St. & Robbins Ave, watched some teenagers & some older persons going into Dan Held’s property with backpacks on a few different occasions.

National Night Out – Motion was made by T. Newton & seconded by W. Campbell to close Acheson Ave. from 16^th St. to 17^th St. on August 7, 2012 from 5:00 – 10:30 PM in conjunction with Kiski Twp’s participation in the National Night Out – ayes 3, nays 0.

1409 Clark Ave – Motion was made by W. Campbell & seconded by T. Newton to file a civil complaint with the courts against the owners of 1409 Clark Ave as their 6 month notice is up – ayes 3, nays 0.

Finances – Motion was made by T. Newton & seconded by W. Campbell to pay regular bills and hold residual bills until a later date.  E. Artman’s wife to do payroll in E. Stitt’s absence with E. Stitt walking her through it on the phone.

Property & Ordinance

1234 Wysocki Ave – Concern was shown about this property.  S. Ross advised property owner, John Clark, had died.  S. Ross will contact John’s wife & report back next meeting.

Streets – B. Beck reported they mowed & trimmed, picked up trash around town, cleaned up the island coming into town, did four dye tests (S. Ross said one alone took three hours), cleaned out catch basins, worked on the catch basin at the Mix property on Birch St, worked on catch basin on Hickory Nut Rd, patching pot holes & picked up tires in the Stoops Ct. apartment parking lot.  B. Beck advised a quote from Donghia Lumber Co. was obtained in the amount of $558.88 for lumber to redo the back steps of the borough building.  Steve Chapman, who has some expertise in this area, will construct them on borough time.  The limestone was ordered for Sharon Wilmot, Robbins Avenue.

R. Rusz inquired as to whether there is a schedule the maintenance workers follow to do their various jobs.  E. Burns said council will sit down with the Streets’ Dept. to discuss accountability procedures.

Motion was made by T. Newton and seconded by W. Campbell to purchase the lumber, etc. from Donghia Lumber for the borough building back steps project – ayes 3, nays 0.

E. Burns raised a question as to the removal of the sliding board in the Helen Clark Playground.  It was removed because it didn’t meet proper standards.

Mayor’s Report – E. Artman read the police activity report for June.  There were 45 calls, 14 incidents, 1 simple assault, 2 traffic citations & 1 non-traffic citation.

Solicitor – A. Urti reported he has a draft of last month’s opinion which needs the signatures of those in attendance of the conditional use hearing.

There was discussion about the drainage onto Willow St. from the Kiski Twp. property.  Was advised that Kiski Twp. wondered if it really was in their township.

E. Stitt signed but has not sent the check for the Real Estate Transfer Tax refund for the transfer of the Beatrice Lackey property.

Anthony Urti advised of a newly passed state law governing boroughs.  He will review and advise of any significant code changes.

Regarding the sewer lines shared by Apollo Borough, Kiski Twp & N. Apollo Borough residents, Apollo Borough & Kiski Twp. will breakdown the properties that will be using the sewer line and have each municipality pay an equable distribution.  E. Burns is concerned that N. Apollo Borough is not being included on this discussion.  A. Urti will convey this concern.

Engineer – B. Bothell provided a written report.  He advised he is still waiting for contract to be returned for ADA ramps & partial 16^th Street paving project. 

B. Bothell reported that the paving has been completed on the sanitary sewer improvement project at 11^th St. in front of Terri’s Styling Salon and owner is ecstatic! 

The catch basin has been installed at the Mix property.

B. Bothell will mail a hard copy of the bill for paving at the site of the 11^th Street sewer line to the borough and hold back a 2% retainer ($960).

Regarding dye testing properties in the borough, specs are being prepared.  Estimate for ½ the project (260 structures at approx. $55/structure) is approximately $14,300.  There is a time restriction for the proposed work so testing will proceed beginning next month.

The Oakwood Ave. water line project – no response back yet; 6-8 mo.

Hickory Nut Rd. – waiting for significant flow.  B. Beck reported that a water leak was repaired by the property owner & the yard is now dry.  If a noticeable flow recurs, B. Beck is to contact the DEP for further testing.

Minutes – Motion was made by T. Newton, seconded by W. Campbell to accept the minutes of the meeting June 4, 2012 as presented – ayes 3, nays 0.

Executive Session – A motion was made by W. Campbell, seconded by T. Newton to go into executive session to discuss personnel situation – ayes 3, nays 0.

Motion to return to regular session was made by T. Newton, seconded by W. Campbell – ayes 3, nays 0.

Part-time Office Position – A motion was made by W. Campbell, seconded by T. Newton to create  a part-time position to 1) assist E. Stitt with his duties & 2) avoid a similar situation in the future.  The position will be three (3) days/week (24 hours) at minimum wage – ayes 3, nays 0.  A. Urti agreed to take care of the advertising for this position.

A motion was made by T. Newton, seconded by W. Campbell to have the borough pay for the recycling of the four tires removed from the Stoop Ct. apartment parking lot – ayes 3, nays 0.

North Apollo Borough Council met in special session at 6:30 PM in the conference Special

room of the municipal building, called to order by President E. Burns, who led the Meeting

Pledge of Allegiance. Roll Call of Members: The following members were present; E. ZHB

Barclay, E. Burns, W. Campbell, T. Newton, and E. Hall. Also present were Mayor E. Appointed

Artman and Sec’y E. Stitt. The purpose of the meeting was to appoint members to the

Zoning Hearing Board.

Three volunteers to the Zoning Hearing Board were named; Donald Acker, 1308 Cedar Acker

Avenue, Vivian Shaeffer, 1506 Redwood Avenue, and Carole Kennedy, 851 16^th Street. Shaeffer

Discussion took place with Patrick Froncek, 1223 Wysocki Avenue, and several other Kennedy

residents of the Pegtown area, who objected to not having any representatives from Appointed

their neighborhood. It was explained that these were the people who put in their names ZHB

for the positions and if another name had been presented, he would have been considered.

Motion was made by T. Newton, seconded by E. Barclay, to appoint Donald Acker,

Vivian Shaeffer, and Carole Kennedy, to the Zoning Hearing Board – ayes 5, nays 0.

There was further discussion with Pegtown residents, regarding representation for Pegtown

their community, blighted properties, high grass, street conditions, and traffic signs. Issues

Andrite Visitors: Visitor Neil Andrite, from the Roaring Run Watershed Association, expressed support for the Patrick Froncek hostel project, citing the positive economic impact that would result. E. Burns noted that no comment could be made by Council until the report is received from the Zoning Hearing Board.
Seismic Cody Lowery, of Ion Technology, explained that his firm is conducting seismic testing to

Testing determine potential sites for Marcellus shale drilling and is seeking permission to set test boxes in the Borough and use trucks that cause vibration in the ground. After discussion regarding potential mine subsidence and benefit to the Borough motion was made by E. Barclay, seconded by T. Newton, To deny permission for seismic testing in the Borough – ayes 3, nays 0.

Campgrd John Linkes echoed the Roaring Run Watershed Association’s support for Patrick

Support Froncek’s campground/hostel project.

Night Visitor Wendy Barclay, 1437 North Ridge Drive, noted that the Neighborhood Watch is

Out participating in the National Night Out at the Fire Hall on August 7 and asked permission to post a sign advertising the event on the Borough building. Motion was made by E. Burns, seconded by T. Newton, to permit a sign advertising National Night Out on the Borough Building – ayes 3, nays 0.

1820 Visitor Delia Fulton, 1816 Moore Avenue, noted poor conditions at 1820 Moore and

Moore and asked if the property was up to code.

Pegtown Visitor Daniel Stone, 1213 Wysocki Avenue, discussed with Council the campers located

Campers along the river. E. Burns noted that the County has been contacted and they must meet with the landowners to discuss the matter.

Recycling Visitor Carole Kennedy discussed with Council the recycling program and the fact that the recycler has not been in the Borough at the scheduled times.

Public Safety: E. Artman read the Police activity report for July. There were 55 total Police

calls, 17 incidents, 1 criminal arrest, 3 traffic, and 2 non-traffic citations. Report

project.
The 11^th Street sewer project is completed and payment in full to the contractor was 11^th St.

A rainwater problem on Clark Avenue at 15^th Street was investigated. An underdrain, Clark

New Code The new Borough Code was discussed.
Centax The TCC meeting of July 26 was discussed with TCC Representative Vivian Shaeffer. Centax has been unable to distribute funds it has collected. They’ve been given a notice of contract cancellation and 90 days to correct the distribution problems. Berkheimer will take over as Earned Income Tax Collector.
ADA B. Bothell reported that Senate Engineering will have an inspector on site for the ADA

Ramps ramp construction.

Balances Treasurer: E. Stitt reported the following July 31, 2012 balances in the Borough’s accounts: General Fund, $143634.02; Garbage & Refuse, $7228.84; Liquid Fuels, $47559.67; Sewer Recovery, $169880.95.
Collected Garbage Fee collections for June and July totaled $6386.42, including $2812.92 in delinquents. Sewer Recovery Fee collections totaled $25556.60, including $883.79 in delinquents.

Visitors: Discussion took place with visitor Scott Robinson, 1206 Wysocki Avenue 1205

regarding the sewer connection at 1205 Wysocki. Wysocki

Pat Froncek, 1223 Wysocki Avenue: discussed with council the recent denial of Froncek

a variance for a campground/bed & breakfast on his property. He presented pictures of Variance

a prior business in an R1 zone. He was told that business was grandfathered. E. Burns

noted that more research will need to be done before council can take action.

The condition of the property at 1820 Moore Avenue was discussed with Delia Fulton: 1820

1816 Moore. It was noted that the property is for sale and will have to be brought up to Moore

code before new owner can occupy. Code Enforcement Officer, Sam Ross, is to work

with the owners to get the conditions corrected.

Kiski Township Officer, Darhl Goldinger, entered the meeting. Junk cars sitting outside Junkyard

the fence at North Apollo Auto Wrecking were discussed with him. E. Artman advised

him to cite the owners for any vehicles that aren’t moved. Conditions at the former

country club property were also discussed with him.

The prospect of having Pegtown rezoned was discussed with Pat Froncek Rezone?
