The regular meeting of North Apollo Borough Council was called to order at 7:00 PM in
the conference room of the municipal building by President R. Crosby, who led the
Pledge of Allegiance. Roll Call of members: Present were W. Campbell, R. Crosby, M.
Dufour, and E. Hall. Absent was D. Acker. Also present were Mayor E. Artman, Sec’y
E. Stitt, Solicitor T. Geary, and B. Bothell from Senate Engineering.
Minutes of the regular meeting of December 6, 2010 and the special meeting of Minutes
December 20, 2010 were accepted as presented by motion of E. Hall, seconded by M.
Dufour – ayes 4, nays 0.
Visitors: Discussion took place with visitor Robin Rearick, 1211 Oakwood Avenue, Water
regarding the application for CDBG funds for a water line for Oakwood Avenue. B. Grant
Bothel noted that he had talked to Carmen Johnson at the County Planning office, and
She had no yet received an application from the Water Authority.
Solicitor: T. Geary advised that liens need to be filed on properties having delinquent Sewer
Sewer recovery accounts. An ordinance will be needed to add legal fees to the liens. Liens
Motion was made by W. Campbell, seconded by R. Crosby, to advertise an ordinance
Allowing legal fees to be added to liens filed – ayes 4, nays 0.
A letter received from Vince Tresco of Tresco Paving was discussed. No action was Tresco

E. Stitt noted that he needs the addresses of residents who need letters advising them to Sump

T. Geary reported that he sent Elizabeth Kopic a complaint regarding conditions and Brank
activities at the property at 1409 Clark Avenue. Ms. Kopic advised that it is hoped that Prop
the property will soon be transferred. Visitor Eugene Burns, 1405 Leonard Avenue, re-
minded Council that an ATV ordinance is needed. Motion was made by W. Campbell,
seconded by R. Crosby, to have the Solicitor prepare an ATV ordinance - ayes 2 (W.
Campbell, R. Crosby), nays 2 (E. Hall, M. Dufour). The vote was tied and Mayor E.
Artman was asked to break the tie. His vote was aye, and the motion passed.
Treasurer’s Report: E. Stitt reported the following December 31, 2010 balances in Treas.
the Borough’s accounts: General Fund, $63,194.84; Garbage & Refuse, $2,092.11; Report
Liquid Fuels, $36,034.36; and Sewer Recovery, $251,476.55.
Garbage Fee collections for December, 2010 totaled $3,088.50, including $1217.50 in Collection
delinquents. Sewer Recovery Fees collected totaled $25,455.83, including $2,415.65 in Report
delinquents.
Finance: Motion to pay the bills presented was made by M. Dufour, seconded by R. Pay Bills
Crosby – ayes 3, nays 1 (E. Hall). (See Voucher Register for January, 2011).
Grants: M. Dufour noted that she needs additional information for a grant application. Info
Armstrong County will have Liquid Fuels aid available this year for road projects. County

Paving Engineer: B. Bothell noted that he has been working on a list of streets for possible paving this year.
Water Curt Fontaine, of the Municipal Authority of Westmoreland County, will be contacted
Grant regarding the application for a grant to install a water line for Oakwood Avenue.
Floodpln The upcoming new floodplain ordinance and map were discussed.
ACBA Correspondence: The Armstrong County Borough Association will meet on January 27, 2011 at Theresa’s Restaurant in West Kittanning.
Old Business: Nothing to report.
Police Police: E. Artman read the Police Activity Report. In December, there were 18 calls, 4 traffic, and 3 non-traffic citations issued.
Meeting R. Crosby reported on a meeting held December 27, 2010 with Kiski Township regarding
Re Police concerns over Police coverage. Complaints were addressed. A proposed regional Police force was mentioned, but no information was available. T. Geary noted that state grants are available for regional police forces, Police calls tend to be weighted more toward the Boroughs. W. Campbell expressed the opinion that any regional police board should include the Mayor.
TCC It was noted that a representative is needed for the County Tax Collection Committee.
Rep. Visitor Vivian Shaeffer volunteered to serve in that position. Motion was made by M. Dufour, seconded by W. Campbell, to appoint Vivian Shaeffer, 1506 Redwood Avenue, to be the Borough’s representative to the County Tax Collection Committee – ayes 4, nays 0.
Junk Discussion took place regarding junk cars sitting outside the fence at North Apollo Auto
Cars Wrecking. Code Enforcement Officer Sam Ross will be contacted about the matter.
Library Visitor Marlene Beck stated that a financial report will be coming from the Apollo Memorial Library soon.
The being no further business to discuss, R. Crosby declared the meeting adjourned at 7:45 PM.

The regular meeting of North Apollo Borough Council was scheduled for 7:00 PM
in the conference room of the municipal building. Members present were Vice
President D. Acker and W. Campbell. Absent were R. Crosby, M. Dufour, and E. Hall.
As no quorum was present, no business could be conducted. It was decided to reschedule
the meeting for Monday, February 14, 2011 at 7:00 PM.

February 14, 2011
North Apollo Borough Council met in special session at 7:00 PM in the conference Special
room of the municipal building with Vice President D. Acker presiding and leading the Session
Pledge of Allegiance. Roll Call of Members: Present were D. Acker, W. Campbell, M.
Dufour, and E. Hall. Absent was President R. Crosby. Also present were Mayor E.
Artman, Sec’y E. Stitt, Anthony Urti from the Law Offices of Geary, Loperfito, and
Faher, Operator B. Beck, and Code Enforcement Officer Sam Ross.
Minutes of the meeting of January 10, 2011 were accepted as presented by motion of Minutes
W. Campbell, seconded by E. Hall – ayes 4, nays 0.
Code Enforcement Officer presented his report of activities during the year 2010. A Code Enf.
total of 31 permits were issued, 19 of them for occupancy inspections. One sewer
violator was taken to court. That individual corrected a zoning issue but has not yet
completed work to correct the sewer violation. There is a potential buyer of the Trotters
building who would like to use the facility sewer supply sales and equipment storage.
Renovations to Luxemburg Manor are underway with all appropriate permits having
issued, mostly by the County UCC enforcement agency. Owners of North Apollo Auto
Wrecking have moved a couple cars behind their fence and are waiting for salvage titles
for others. The Police have stated that they will cite illegally parked cars at the yard. The
Hunt Brothers, who own the property, claim that they own Hunt Street. Partial
reimbursement for the purchase of a new fax machine, which cost $144.00, was requested.
Discussion took place regarding the ownership of Hunt Street. Ben Bothell from Senate
Engineering entered the meeting.
Discussion took place regarding the use of fire rings for recreational fires. D. Acker Fire Rings
noted that the Police and Fire Department are to use common sense to determine if a
fire is dangerous.
Treasurer’s Report: E. Stitt reported the following January 31, 2011 balances in the Treasurer
Borough’s accounts: General Fund, $56, 304.88; Garbage, $1,021.88; Liquid Fuels, Report
$27,420.17; and Sewer Recovery $244, 849.13.
Garbage Fees totaling $6,294.75, including $431.75 in delinquents, and Sewer Collection
Recovery fees totaling $1,943.76, including $830.58 in delinquents, were collected

Report in January, 2011. First quarter Garbage Fees are being collected now, and Sewer Recovery Fee billing will be going out in February.
County Grants: M. Dufour reported that a an application for County Aid for paving has been sent in.
Eng. Engineer/Streets: B. Bothell gave estimates for paving 16th Street in two parts and
Estimates Robbins Avenue from 16th to 13th. 16th Street from River Road to Cochran was estimated at $70,710.00 and from Cochran to Birch was estimated at $40,650.00. Robbins Avenue was estimated at $55,075.00. Discussion took place regarding the possibility of paving Robbins up to the Wilmot residence and putting that section on the Borough’s Liquid Fuels list.
Crew B. Beck reported that 19 ton of antiskid and 23 tons of salt were received. A plow shoe
Report bracket on the plow for the ’88 truck was welded. The crew has been doing alley maintenance. A new plow cradle was ordered for the ’01 truck because the old one broke. Streets were toured with B. Bothell for ideas on future paving. The ’88 truck is running well with its new engine. The plow rams were replaced on the ’88 truck plow.
Police Mayor/Police: E. Artman reported there were 18 total Police calls in January. Four traffic and three non-traffic citations were issued. The coverage by the Kiski Township Police was discussed.
Bills W. Campbell questioned the bills from A & G Auto Parts. B. Beck explained that it was for transmission fluid and filter for the ’01 truck. Also questioned was the bill from Holbein Contracting for snow removal when both street crew employees were off work. The number of hours spent was in doubt.
Delqs. Delinquent Sewer Recovery bills were discussed. The possibility of the Solicitor sending notices to the offending parties and adding the legal fees for doing so to the bill is to be investigated..
Tresco Solicitor: Anthony Urti reported that Tresco Paving threatened to remove blacktop that
Threat was put down on Clark Avenue in response to the Borough not paying the full amount of
ATV Ord. the 2010 paving bill. Also, the ATV ordinance, which prohibits ATVs from being ridden on private property without owners written permission and places other limitations on ATV use in the Borough has been written and is ready to advertise.
Ord 306 Motion was made by D. Acker, seconded by W. Campbell, to advertise Ordinance 306-2011, which pleases restrictions on the use of ATVs within the Borough, for adoption at the April 4 meeting – ayes 2 (Acker, Campbell), nays 2 (Dufour, Hall). Mayor Artman was asked to cast the deciding vote, and he did so, voting in favor of the motion. This resulted in the motion passing by a vote of 3 ayes , 2 nays.
Brank The Brank property at was discussed. Foreclosure has not taken place.
Tax Coll. Finance: D. Acker reported that Earned Income Tax collections totaled $5,014.85 for

December, $5,040.26 for January, and $632.32 for February to date.
Motion was made by D. Acker, seconded b y E. Hall, to pay Sam Ross $72.00 toward Ross
the cost of the new fax machine that he purchased for Code Enforcement work – ayes $72.00

Motion was made by D. Acker, seconded by W. Campbell, to pay the Minimum Pay MMO
Municipal Obligations to the pension plans when the State funding is received in October
without added interest – ayes 4, nays 0.
Eugene Burns agreed to continue as the Borough’s representative to the County UCC Burns
Board and the Ucc Appeals Board. UCC Rep.
Engineer: B. Bothell advised that sewers need to be upgraded to minimize water flows Sewer
into the sanitary system. Inserts in the manholes is one way to help cut down stormwater Upgrade
flows. Eugene Burns recommended studying the system.
B. Bothell advised that the Water Authority has submitted the water line proposal to the Water
County Planning Department.
The Flood Plain ordinance should be ready for action soon. Flood Ord
B. Beck reported that the trucks are working well. The plow has been repaired on the ’01 Street Wk
by Tink Faber’s son at a cost of $100.00 in labor. A manhole neaer the UPS terminal
needs work. The Water Authority has dug up a place on the newly paved part of Acheson
Avenue. A truck parked along Beaver Alley has been causing difficulties for the snow
plow and the garbage truck.
W. Campbell noted that Andrea Acker was appointed to the position of Auditor rather A. Acker
than elected.

The regular meeting of North Apollo Borough Council was called to order at 7:00 PM in the conference room of the municipal building by President R. Crosby who led the Pledge of Allegiance. Roll Call of Members: The following members were present; D. Acker, W. Campbell, R. Crosby, M. Dufour and E. Hall. Also present were Sec’y E. Stitt, Solicitors T. Geary and A. Urti, B. Bothell from Senate Engineering, and Operator B. Beck. Mayor E. Artman was not present.
Minutes Motion was made by W. Campbell, seconded by E. Hall, to accept the minutes of the meeting of February 14, 2011 as presented – ayes 5, nays 0.
River Visitors: Vivian Shaeffer, Redwood Avenue, announced that there will be a river walk
Walk from Apollo to the Leechburg bridge on September 17. During discussion it was noted that the Police should be notified of the activity, so that adequate manpower can be scheduled.
Streets Discussion took place with Paul Walsh and Ed De Paoli, 16th Street, regarding the need for repairs and paving of 16th Street. It was noted that paving will be limited due to cost and the likelihood that no County Aid will be received.
Delqs The handling of delinquent accounts was discussed with visitor Paul Walsh. T. Geary advised that delinquent account holders are to be given a 60 day amnesty period to pay off their accounts, then their properties will be liened.
Flooding Visitor Greg Mix, Birch Avenue, reported that his property is being flooded by a storm
Birch Ave drain belonging to the Borough. Motion was made by D. Acker, seconded by E. Hall, to have the drainage problem fixed as needed, and advertise for bids if estimates are more than $10,000.00 – ayes 5, nays 0.
Drainage Visitor Ray Bartha reported of an ongoing basement flooding problem at 402 20th Street.
20th St. B. Bothell advised that the problem would have to be researched and recommended that a camera crew be brought in to video the storm drains to determine the cause of the problem.
Parking Fire Chief Jason Burns reported that the Fire Department is purchasing a fire truck to
Acheson replace the older of their two units, and, due to its size, an addition is being built on the fire hall. Also, parking will need to be restricted at the upper end of Acheson Avenue to allow room for the truck to get in and out of the hall. After some discussion with T. Geary regarding what action would be needed, motion was made by M. Dufour, seconded by W. Campbell, to make Acheson Avenue from 17th to 16th Street a No Parking zone – ayes 5, nays 0.
V.F.D. Fire Chief Burns also asked the Borough to consider additional funding for the Fire
Finances Department due to the need for funds for the new truck and the addition. He noted that grant money is helping with the building, and the truck is a used unit, but considerably newer and in better condition than the one being replaced. It is being purchased for a fraction of its new cost.

Motion was made by W. Campbell to place the referendum establishing the .75 mill Library
tax for the Apollo Library back on the ballot. Discussion ensued regarding the wording Tax
of the original referendum in which a yes vote was actually a vote against the payment
and visa versa. Visitor Marlene Beck recommended checking out the library before
any action. There was also discussion regarding the contributions made to the Fire
Department vs. those made to the library. In the end, the motion died for lack of a second.
Further discussion took place as to how to go about increasing the funding for the Fire $5000
Department. Since it was determined that neither a tax increase nor a change in the To VFD
Library contribution could be out into effect until 2012, motion was made by R. Crosby,
seconded by D. Acker, to authorize a contribution of $5,000.00 to the North Apollo
V.F.D. in addition to the budgeted contribution of $12,000.00 – ayes 5, nays 0.
Solicitor: T. Geary advised that a water tap-in ordinance is needed if CDBG funding Water
is to be used to install a water line for Oakwood Avenue. A proposed ordinance was Tap-in
presented. After discussion, motion was made by R. Crosby, seconded by E. Hall, to Ord 307
advertise Ordinance 307-2011, which requires residents to tap into the public water line
if one passes in front of their property, for adoption at the April 4 meeting – ayes 5, nays
0.
A new Flood Plain Ordinance has been written and needs to be adopted upon approval Flood
by FEMA. Motion was made by E. Hall, seconded by D. Acker, to authorize advertising Plain Ord
of Ordinance 308-2011, the Flood Plain Management Ordinance, once approval is
received from FEMA – ayes 5, nays 0.
It has been determined that Hunt Street is owned by the Borough, not North Apollo Auto Hunt St.
Wrecking.
There will be an amnesty period of 60 days for payment of delinquent accounts to the Delq.
Borough. If not paid in full by that time, the properties will be liened. T. Geary will Amnesty
print a letter to send to those with delinquent accounts.
Treasurer’s Report: E. Stitt reported the following February 28, 2011 balances in the Account
Borough’s accounts: General Fund, $47,188.44; Garbage & Refuse, $5,394.88; Liquid Balances
Fuels, $24,604.28; and Sewer Recovery, $238,878.76.
Garbage Fees totaling $11,787.00, including $1,136.75 in delinquents, and Sewer Rec. Collected
Fees totaling $1,438.04, including $892.34 in delinquents were collected in February.
Finance: D. Acker reported that $6,091.86 in Wage Tax was received in February W/Tax

Public Safety and Grants: Nothing to report.
Property & Ordinance: Nothing to report.
Street Streets: B. Beck reported that the street crew has been plowing snow and patching
Report potholes. A price is being obtained for bringing a large dump truck in to tailgate street millings to repair the alleys. Humps in Stoops Court are being investigated to determine cause. A sewer backup problem at 11th Street and River Road was found to be caused by a blockage in the sewer line leading from the last two properties in North Apollo. This line was not known to exist before and it was thought that the properties had septic systems. Solutions to the problem are being sought.
Street The Water Authority cut openings into newly paved Acheson Avenue, pointing to the

Paving B. Beck recommended paving Wemple Avenue before Robbins is done.
Screener W. Campbell recommended getting a screener to screen the millings that are used in the alleys. D. Acker suggested getting a price.
R. Road Engineer: B. Bothell advised that the terra cotta sewer pipe along River Road near 11th Street should be either sleeved or replaced.
Inflows There was nothing new on the inflow issues since recent flooding problems took precedent.

The regular meeting of North Apollo Borough Council was called to order at 7 PM
in the conference room of the municipal building by President R. Crosby, who led the
Pledge of Allegisnce. Roll Call of Members: Present were D. Acker, W. Campbell, R.
Crosby, M. Dufouor, and E. Hall. Also present were Sec’y E. Stitt, Solicitors T. Geary
A.Urti, B. Bothell from Senate Engineering, and Equipment Operator B. Beck.
Minutes of the meeting of March 7, 2011 were accepted as presented by motion of D. Minutes
Acker, seconded by E. Hall – ayes 5, nays 0.
Solicitor: T. Geary noted that Ordinance 306-2011, the ATV ordinance, is ready for Ords 306
adoption as is Ordinance 307-2011, the ordinance requiring tap-in to the water lines. And 307
Approval for the new Floodplain Ordinance has not yet been received from the State.
The sewer line to the Dykes and Greer property is going to be repaired. It was suggested River Rd.
that these homes be turned over to Apollo for Sewer Recovery billing and sewer Sewer
maintenance after the repairs are complete.
Amnesty letters to delinquent Sewer Recovery and Garbage customers have been Amnesty
delayed, but they will be done, and the amnesty date will be adjusted accordingly. Letters
Vandergrift and Leechburg have sued the Kiski Valley Water Pollution Control KVWPCA
Authority and the rest of the participating municipalities have become involuntary Lawsuit
plaintiffs subject to whatever ruling is issued.
Discussion took place regarding the ATV ordinance. T. Geary noted that a person ATV Ord.
testing an ATV after repairs would not be in violation.
Motion was made by D. Acker, seconded by W. Campbell, to adopt Ordinance 306-2011 Ord 306
the ordinance regulating the use of recreational vehicles within the Borough of North ATVs
Apollo and providing penalties for violation – ayes 2 (Campbell and Acker), nays 2 Adopted
(Crosby and Dufour). E. Hall was undecided until further discussion took place with
Council and visitors. Hall then voted aye, making the vote ayes 3, nays 2 and the
ordinance was adopted.
The drinking water problem at the William Hilty property, 402 12th Street was discussed. Hilty
His water is rusty and muddy and tapping and flushing the line is only effective for a Water
short time. T. Geary is to contact the Water Authority Solicitor regarding a solution.
Motion was made by M. Dufour, seconded by R. Crosby, to adopt Ordinance 307-2007 Ord 307
an ordinance requiring property owners to tap into the public water system if a line runs Water Tap
past their property – ayes 5, nays 0.
