Sealed proposals shall be received on or before the Bid Due Time/Date and at the Bid Receipt Location specified in this Notice to Contractors.
Sealed proposals WILL be stamped with the time and date that the proposal was received by the University at the Bid Receipt Location.
Brief Description of Work:
The project consists of Work at East Stroudsburg University of Pennsylvania, East Stroudsburg Borough, Monroe County, Pennsylvania.
Construct a 10 foot wide walkway from the Fine and Performing Arts Center to the northwest corner of the University Ridge parking lot. This walkway is to be lighted, have emergency call boxes at approximate 500 foot intervals and be capable of carrying University Police patrol vehicles and ambulances. Network connectivity from the Fine and Performing Arts Cent to the University Ridge student housing will be provided by fiber optic cable in conduit parallel to the walkway.

The Costs Ranges are specified to give potential Bidders an idea of the size of the project. All ranges are standard and the Construction Estimate is matched to a Standard Cost Range. There is no relationship as to where the Construction Estimate fits within the range, other than that it falls within the range.

Bid Guaranty: 5% of the highest base bid payable to

Performance Bond: 100% of the contract price.

Maintenance Bond: 10% of the contract price.
Proposal Period: 60 Calendar Days allowed from Bid Opening until Award of Contract.

NOTICE TO CONTRACTORS Contractual Requirements

Bid Guaranty
Refer to the Notice To Contractors and the Bid Form for requirements to submit a Bid Guaranty.
Form and Amount of Guaranty. If required, a Bid Guaranty shall accompany each Bid Proposal in the form of a Bid Bond, Certified Check, or Bank Cashier's Check. When submitted, a Bid Guaranty shall be in the amount (percentage) specified in this Notice To Contractors and in the form specified in the Bid Form.
Failure to submit a required Bid Guaranty in the amount required will result in the rejection of the Bid Proposal as non-responsive.
If a Bid Bond is submitted, the bond shall meet the following requirements:

System-furnished Bid Bond Form. The Bid Bond shall be submitted on the System-furnished Bid Bond Form, complete with all signatures, seals, power of attorney certification, and correct dates. Failure to submit the Bid Bond on the System-furnished Bid Bond Form will result in the rejection of the Bid Proposal as non-responsive.

Approved Surety. The Bid Bond shall be from a Surety approved to do business in Pennsylvania. For information on approved Sureties, contact the

Proper Execution. The Bid Bond shall be properly executed by the Surety.

Original Signatures. All signatures on the Bid Bond shall be original signatures.

Power Of Attorney. The Bid Bond shall be accompanied by a power of attorney from the surety company, indicating that the agent signing the bond has the authority to bind the company. The power of attorney shall bear the same date as the Bid Bond.

Alterations. Any alterations to the bond, e.g., erasures, write overs, or white outs, are not acceptable, unless initialed by an authorized representative of the surety, preferably the agent signing the bond.
Such unauthorized alterations, if they are to date, amount of bond, or name of bidder, will result in the bid being rejected as not responsive. Failure to comply with any section of this Instruction will result in the rejection of the bid as not responsive.

Performance and Payment Bonds
Performance and Payment Bonds in the amounts (percentages) specified in this Notice To Contractors are required for the Work performed under contracts awarded for this Project.
Bonds will be requested from the low, responsive, responsible bidders prior to the award of Contracts. Required Bond forms are contained in Rider F – Bonds, of the System's Standard Form of Agreement for Facilities Projects.
A Maintenance Bond in the amount (percentage) specified in this Notice To Contractors is required for the Work performed under contracts awarded for this Project.

Contractor's Insurance
The Contractor shall maintain acceptable worker's compensation, employee's liability, broad form comprehensive general liability, comprehensive automobile liability, and Builder's Risk Insurance in the amounts and types of coverage specified in Rider B - General Conditions, of the System's Standard Form of Agreement for Facilities Projects.

Debarred Contractors
Contractors currently under suspension or debarment by the Commonwealth, any other state, or the federal government are not eligible for an award of contract for this project. Proposals received from suspended or debarred Contractors will be rejected at the sole discretion of the System.
Additionally, contractors shall not contract with or employ subcontractors or individuals that are currently under suspension or debarment by the Commonwealth or federal government. Proposals that are determined to contain suspended or debarred subcontracts or individuals will be rejected at the sole discretion of the System.

Product Substitution
Any Product Substitution requests shall be submitted to the Design Professional a minimum of 10 calendar days prior to the date set for receipt of Bid Proposals.
Product Substitutions that are accepted will be published in an addendum.
After the Bid Opening, Product Substitutions will be considered, at the sole discretion of the System, only for those conditions listed in Section 01631 – Product Substitutions.

MINORITY AND WOMEN OWNED BUSINESS ENTERPRISES (MBE/WBE) Participation
In the preparation and submission of “Exhibit A – Solicit Information Sheet for MBE/WBE Subcontractors and Suppliers” of the Bid Proposal/Bid Form, the Bidder shall proactively solicit the participation of MBE/WBE firms as subcontractors, suppliers, and/or vendors in the Reasonable Effort Award Amount (REAA) participation levels specified in the Notice To Contractors. The Pennsylvania State System of Higher Education’s MBE/WBE Program is specified in the Bid Form.
All bidders must directly contact certified MBE/WBE subcontractors and/or suppliers to request quotes. Bidders must solicit MBE/WBE firms in a timely manner to allow sufficient time for a response, in the same manner bidders solicit from other subcontractors and suppliers. In order for a solicitation to be considered a qualified, proactive solicitation, the request for quotations must contain the following minimum information:
1. The solicitation must be written, and on the bidder's business letterhead.
2. The date of the solicitation.
3. The name and address of the MBE/WBE firm being solicited.
4. The project name and number.

A listing of the specific equipment, materials and supplies, including approximate quantities, that the bidder intends to purchase or lease. The scope of work for any subcontract work should be clearly outlined.

Instructions as to where the plans and specifications (if not attached) are available for the MBE/WBE firm to review.
Information regarding the availability of certified Minority and Women Business Enterprises (MBE/WBE) may be obtained from the Commonwealth of Pennsylvania, Bureau of Contract Administration and Business Development, at 717-783-3119 or 412-826-5656. You may also access the following web page in order to identify MBE/WBE firms: “http://www.dgs.state.pa.us/cabd/mwbdata.htm”. Those minority and women owned firms certified by the Department of General Services, as listed therein or subsequently approved, are pre-approved and acceptable to the System as MBE/WBE firms. Contractors may also submit other minority and women owned businesses that have been certified by other states or by other duly constituted public bodies.

Contract Requirements
The Pennsylvania State System of Higher Education's Standard Form of Agreement with Riders, Special Requirements, and General Requirements shall apply to this project. If the Bidder takes exception to the Standard Form of Agreement, the Bid Proposal will be rejected as non-responsive at the sole discretion of the System.
A copy of the Contract Form is included in this Project Manual.

Qualifications of Bidders
The Contractor shall maintain current licenses as required by applicable state or local jurisdictions for any regulated activity related to the Work.

CONTRACTOR’S QUALIFICATION STATEMENT
The apparent low bidders may be requested to submit a contractor's qualification and financial statement within ten (10) calendar days of bid date, with financial information current within twelve (12) months prior to the Bid Date. Failure to submit the required information, when requested, may result in rejection of the Bid Proposal.
11. BUILDING PERMITS
No Building Permit is required for this project from the Pennsylvania Department of Labor and Industry (L&I). In accordance with Article 3.6 - Permits, Fees and Notices, of Rider B – General Conditions of the Contract Agreement, each prime contractor shall obtain any and all other permits required for the project such as street opening permits, from local and state authorities as required by law and regulations. The Contractor shall pay all fees associated with these permits at no additional cost to the University. The Contractors shall comply with the Uniform Construction Code (UCC).
