process. The legal doctrine of P.G. Vinogradov is of significant scientific interest for
modern jurisprudence. This is explained, on the one hand, by the need to eliminate gaps
in the history of legal scientific knowledge in Russia, on the other hand, by the special
importance of research on methodological approaches to the study and interpretation
of law in the context of modernizing modern Russian legal doctrine, as well as by the
heuristic significance of the sociological approach as an example of theoretical
understanding of legal practice. The foregoing testifies to the scientific and practical
relevance of the chosen topic of the dissertation research.
The degree of scientific development of the problem. Legal concept of P.G.
Vinogradova has not yet received deep coverage in Russian legal science. The closest
attention was
paid to his historical concept, the methodology of historical research,
which, obviously, is explained by the deep influence that his historical research had
during the life of a theoretician. Thus, it is difficult to overestimate his research on
medieval English society, which received the highest marks not only from domestic,
but also from European, English historians. This explains the fact that the studies of
P.G. Vinogradov arouse scientific interest among his contemporaries, as evidenced by
a large number of scientific reviews and reviews of his works,
usually devoted to
historical topics (N.M. Borozdin, V.A. Goltsev, D.M. Petrushevsky, A.N. Savin, VG
Fogsten and others). The attention of scientists was also attracted by issues related to
the methodology of social research. Scientific and critical assessment of the
methodological approach of P.G. Vinogradov is given by such contemporaries as A.S.
Alekseev, N.N. Alekseev, V.P. Buzeskul, S.A. Vengerov, N.I. Kareev, N.M.
Korkunov, V.O. Klyuchevsky, P.N. Milyukov, A.S. Yaschenko and some others. The
next stage in the development of ideas about the social, historical and legal concepts of
P.G. Vinogradov is associated with Soviet social and humanitarian knowledge, with
studies devoted to the methodology of the political and legal views of the theorist, and
elucidation of his role in the formation of the Russian historical school.
Among the

and some other researchers. The most significant in the study
of the theoretical and
methodological foundations of the social and legal doctrine of P.G. Vinogradov of this
period, according to the author, are G.P. Myagkov "The "Russian historical school" of
general historians and its role in the ideological and political struggle of Russia in the
late 19th - early 20th centuries" and A.G. Glebova “Problems of the history of the
English medieval peasantry in the work of P.G. Vinogradov”, in which the positivist
methodology of the theorist, his political views are analyzed in sufficient detail, and
the features of his legal understanding are considered.
It is obvious that the interest of the scientific community in the theoretical and
legal work of the scientist, which has been growing in recent years, leads to the need
to comprehend his theoretical views on law. So, on the one hand, this trend is expressed
in the publications of his works devoted to theoretical issues of jurisprudence, and on
the other hand, it is expressed in general theoretical assessments that appear in these
publications in the form of introductory articles. In this regard, it is worth highlighting
the studies of V.A. Tomsinov, distinguished by the depth of scientific analysis of the
legal concept of P.G. Vinogradov. Based on the content of the research tasks solved by
P.G. Vinogradov in different periods of his life, as well as the evolution of the
theoretical and methodological concept, three main periods can be distinguished in his
work: historical and sociological, the peculiarity of which is the reduction of research
tasks to the social reconstruction
of historical phenomena, the application of the
methodology of sociological naturalism; historical and legal, the peculiarity of which
is the creation of a political and legal model of medieval English society by identifying
a system of legal factors that determined its features and characteristics common to
feudalism; theoretical and legal, the peculiarity of
which is the definition and
implementation of the task of creating a legal concept within the framework of the
doctrine of the general theory of law.
