 AS A SOURCE FOR STUDYING THE TRANSITION 
PERIOD OF HANAFISM IN CENTRAL ASIA

The significance of the legal scholars of early post-Mongol period of Central Asia is 
understudied. Maḥmūd al-Ustrūšanī is one of a few Hanafite scholars who lived in these turbulent 
times and tried to find balance between norms of sharia and newly enforced Mongol law

. His full 
name is Ǧalāl al-Dīn Maḥmūd b. al-Ḥusain b. Aḥmad al-Ustrūšanī. The attribution of the book to 
him is attested through a quotation of the author in the manuscript (MS Carullah 596, fol. 2r) and 
external sources. 
Bibliographical information on the scholar’s personal life is very scarce. ʽAbd al-Qādir al-
Qurašī (d. 775/1373), one of the earliest among the Hanafite biographers, did not give an entry on 
any member of Ustrūšanīs. According to the editor al-Ḥulw, the margin of the manuscript contains 
the following information on our author’s son Maǧd al-Dīn: “… author of 
Aḥkām al-ṣiġār
”.

The scholar was born in Ustrushana, which according to as-Samʽānī (d. 562/1166) is situated 
next to Samarkand.

century the Maḥmūd moved with his family to Samarkand, 
where he worked creatively. The life of Ustrūšanīs (Maḥmūd and his son Maǧd ad-Dīn) coincides 
with the first stage of the Mongol invasion and the last period of development of the Samarkand 
school of jurisprudence. This peculiarity provides us an opportunity to clarify the issues related to 
determining the place of 
faqīh
s in society in the first years after the Mongol invasion.

However, in none of them the biographies Ustrūšanīs 
family and their scientific legacy have not been studied comprehensively.
Preliminary studies show that we have to try to elucidate the biography of Maḥmūd through 
information on his son Maǧd ad-Dīn. In the course of research, it was discovered that one of the 
manuscripts of the Institute of Oriental Studies named after Abu Rayhan Beruni of the Academy of 
Sciences of the Republic of Uzbekistan contains the work entitled 
al-As’ila wa l- aǧwiba
(“Questions and Answers”). This work has not yet been recorded in any work of 
ṭabaqāt
genre. The 
work gives us completely new information about this family of scholars. As a result, some opinions 
about the scholar become clearer on the one hand and more confusing on the other. 
The fact is that the available sources state that Maǧd ad-Dīn al-Ustrūšanī died in 632/1234-35, 
and the year of his birth was not mentioned. However, the scholar himself wrote in the introductory
