12. Transaction value of goods, means,
(A) the price actually paid or payable
(B) 110% of cost

13. The price actually paid or payable in determining the transaction value, there shall be added to 
the price actually paid or payable for the imported goods, 
(A) commissions and brokerage, except buying commissions 
(B) following goods and services were supplied directly or indirectly by the buyer free of charge or at 
a reduced cost (i) materials, components, parts; (ii) tools, dies, moulds and similar items used in the 
production of the imported goods; (iii) materials consumed in the production of the imported goods; 
(iv) engineering, development, artwork, plans, sketches, design work commenced elsewhere than in 
India and essential for the manufacture of imported goods; 
(C) License fees and royalties related to the imported goods 
(D) The value of any part of the proceeds of any subsequent resale, disposal or use of the imported 
goods that accrues, directly or indirectly, to the seller
(E) all other payments made or to be made as a condition of sale of the imported goods, by the buyer 
to the seller,
(F) all of the above 
14. Any person wronged by any decision or order passed under this Act by an officer of customs lower 
in rank than a [Principal Commissioner of Customs or Commissioner of Customs] may appeal to the 
[Commissioner (Appeals)] [within………….] from the date of the communication to him of such decision
