Liability
5.1 
DIgSILENT’s Obligation 
DIgSILENT undertakes to render the maintenance and technical support services with all due care. 
The Licensee is reminded of the fact that according to the state of the art of software technique, it is not possible 
to produce software, which excludes the risk of malfunction, and moreover elimination of faults may prove 
impossible or involve a lengthy process. Therefore, it is incumbent on the Licensee to take due regard of this fact 
when utilizing the Software and the computer system in general. 
DIgSILENT's liability is in accord with statutory provisions, and limited to the value of the fees charged for the 
services rendered. DIgSILENT shall not be liable for any direct, indirect, consequential or incidental damages 
including damages for loss of business profits and business operation.
 
6. 
Force Majeure
In cases of force majeure which substantially impede or render impossible DIgSILENT's services, DIgSILENT is 
entitled to postpone the fulfillment of its obligations for the period of such cases plus a reasonable preparation 
period. Equivalents to force majeure are: strikes, staff lockouts, delay of deliveries from third parties, and similar 
circumstances, which affect DIgSILENT directly or indirectly. 
 
7. 
Fees, Subsidiary Services, Conditions of Payment
7.1 
Maintenance Fees, Adjustment of Fees
The maintenance fee as an amount payable annually per Software product can be found in the license description. 
It applies to all services stipulated in Subclauses 2.1. 
Traveling expenses and installation costs shall be billed additionally. 
7.2 
Additional Services 
Services rendered by DIgSILENT as the result of the Licensee reporting a defect which is not attributable to a 
malfunction of the Software forming the subject of this Maintenance Agreement, and for a defect for which it is 
established that the cause is due to a circumstance listed in Clause 4 will be billed according to the work performed.
