DEFINING MINORITIES FOR ADEQUATE PROTECTION UNDER 

INTERNATIONAL LAW: AN EXAMINATION

Abstract 

The  question  of  adequately  protecting  minorities  under  international  law  remains  quite 

problematic. There have been major  inroads in  that area but  the very definition  of  the term 

‘minorities’  has  remained  controversial.  In  fact,  many  doubt  the  usefulness  or  relevance  of 

any such precise definition. This paper was aimed at examining this ‘definition problem’. This 

was  done  through  analysing  literature  and  thus  arguments,  on  the  subject.  The  paper  finds 

that because of  the varied and unique situations  of  minorities  around  the world,  reaching  a 

single  definition  of  the  term  would  be  near  impossible  thus  making  the  relevance  of  such 

doubtful.  It  recommends  that  attention  be  focused  on  improving  the  minority  protection 

regime, rather than on formulating a single definition since minorities can easily be identified 

in many circumstances. The paper concludes by calling on states to take steps to ensure that 

minorities  within  their  territories  are  adequately  protected  as  this  is  essential  to  the 

preservation of peace.
