RESOLUTION OF THE TOWNSHIP/BOROUGH OF ____________________
DELAWARE COUNTY, PENNSYLVANIA
on the
CONTINUING PLANNING REQUIREMENTS OF ACT 537
PENNSYLVANIA SEWAGE FACILITIES ACT
WHEREAS, The Pennsylvania Sewage Facilities Act, Act No. 537, requires that each municipality in the Commonwealth shall submit to the Department of Environmental Protection of the Commonwealth of Pennsylvania an officially adopted plan for providing adequate sewage facilities for areas within its jurisdiction; and
WHEREAS the Act further requires that each municipality shall from time to time submit revisions of such plan as many be required by rules and regulations adopted as described in the Act or by order of the Department of Environmental Protection; and
WHEREAS, the Delaware County Planning Department, in 2002, prepared the Delaware County Act 537 Sewage Facilities Plan Update: Eastern Plan of Study, which was adopted by the County’s eastern municipalities as its official Sewage Facilities Plan as required under Act 537; and in 2004, prepared the Delaware County Sewage Facilities Plan Revision: Western Plan of Study, which was adopted by the County’s western municipalities as its official Sewage Facilities Plan as required under Act 537; and
WHEREAS the Department of Environmental Protection has approved a Plan of Study for update revision to the 2002 and 2004 Sewage Facilities Plans for the DELCORA Eastern Service Area in order to investigate alternatives for providing for future long-term, cost effective, and environmentally sound conveyance and treatment of sewage currently conveyed to and treated at the Philadelphia Southwest Water Pollution Control Plant; and
WHEREAS the study area encompasses all municipalities tributary to the Radnor Haverford Marple, Darby Creek Joint, Muckinipates, and Central Delaware County Sewer Authorities, including portions of Easttown and Tredyffrin Townships in Chester County, as well as municipalities connected directly to the City of Philadelphia Cobbs Creek Interceptor. Municipalities in the study area include Aldan, Clifton Heights, Collingdale, Colwyn, Darby, East Lansdowne, Folcroft, Glenolden, Lansdowne, Millbourne, Morton, Norwood, Prospect Park, Ridley Park, Rutledge, Sharon Hill, Swarthmore, and Yeadon Boroughs; and Darby, Easttown, Edgmont, Haverford, Marple, Nether Providence, Newtown, Radnor, Ridley, Springfield, Tredyffrin, Upper Darby, and Upper Providence Townships; and
WHEREAS the Delaware County Planning Department has invited the municipalities in the DELCORA Eastern Service Area to participate in the preparation of this plan at no cost to the municipalities;
NOW, THEREFORE, BE IT RESOLVED THAT the Council/Supervisors/Commissioners of the Township/Borough of Municipality hereby agree that at this time, the continuing planning requirements of Act 537 should be accomplished at the multi-municipal level by the Delaware County Planning Department, and that the Council/Supervisors/Commissioners of the Township/Borough of Municipality will cooperate in the preparation of such a plan, including the provision of access by the County or its designee to its records and, if appropriate, to its sewer lines.
BE IT FURTHER RESOLVED that the plan update revision prepared for the western half of Delaware County, including the Township/Borough of Municipality, will be considered by the Council/Supervisors/Commissioners of the Township/Borough of Municipality for adoption as its official Sewage Facilities Plan under Act 537, and that the plan will be submitted by the County to the Department of Environmental Protection for approval.
