1. 
Definitions 
1.1 
'Court Officer' means such member or members of the Court Registry 
staff as the Principal Registrar may from time to time in writing 
nominate. Until a written nomination is made the Court Officer shall 
be the Manager Customer Service or, in their absence, the Manager 
Listings. 
2. 
Filing documents in 
Criminal Property Confiscation Act 2000
(WA) 
matters 
 
2.1 
Applications made under the 
Criminal Property Confiscation Act 2000
(WA) (
CPCA
), by originating summons or motion pursuant to O 81FA 
rr 2 or 3, are to be presented for filing electronically using the ECMS, 
unless there is an exemption under O 67A r 3(1).
2.2 
Objections made under the CPCA, by summons or originating 
summons pursuant to O 81FA r 5, are to be presented for filing 
electronically using the ECMS, unless there is an exemption under 
O 67A r 3(1).
2.3 
A person who presents a document for filing in a CPCA application or 
matter which contains any information which is restricted under CPCA 
s 70 must advise the Court in accordance with O 67A Div 3.
2.4
With the exception of applications filed by the Corruption and Crime 
Commission, where a paper copy of an application or objection is filed 
in accordance with the Rules and an electronic copy is not filed, the 
Principal Registrar (or person delegated by the Principal Registrar) will 
convert the document to an electronic format and record it in the ECMS 
as if it had been filed electronically.
3. 
CPCA Directions List and CPCA Managing Judge 
 
3.1 
Applications and objections which are accepted for filing are referred to 
Listings, to be placed in a 'CPCA Directions List' no earlier than six 
weeks after the date of filing.

3.2
Matters on the CPCA Directions List will generally be listed for 
directions at 9.15 or 9.30 am.
3.3
The CPCA Directions List will generally be held once per month.
3.4
Matters on the CPCA Directions List will be managed by a designated 
judge, referred to as the 'CPCA Managing Judge'. 
3.5 
The orders that will be made by the CPCA Managing Judge in relation 
to matters in the CPCA Directions List are limited to: 
(a)
procedural direction(s) (including, but not limited to, a direction 
to a party to provide to the Court any information that it requires 
and/or a direction as to persons to be added as parties); 
(b) 
an order adjourning the matter to a CPCA Directions List on a 
later date for further directions;
(c) 
an order that the matter be listed for substantive hearing before a 
Judge;
(d)
where an order is made under par 3.5(c), programming orders 
for the substantive hearing (which may include orders, for 
example, that affidavit evidence stand as the evidence in chief, 
that regulate objections to affidavits, that provide for notice to be 
given as to whether a deponent will be required for cross 
examination, and that provide for the filing of submissions); 
(e) 
other interlocutory orders by consent; and 
(f) 
orders for dismissal of proceedings by consent.
3.6 
Subject to par 3.5(f), final orders, including declarations, will not be 
made in the CPCA Directions List, even if they are by consent. 
3.7 
Once an applicant has completed all the necessary procedural steps and 
complied with all directions made, the CPCA Managing Judge may 
make an order that: 
(a)
the matter be listed before a judge of the Supreme Court for a 
hearing of [number of hours] duration; and

(b)
the parties are to provide their unavailable dates to Listings by 
[date], by way of email to 
[e-mail]
.  
3.8 
The Associate to the CPCA Managing Judge will, as soon as possible, 
advise Listings of the terms of an order that the matter be listed for 
substantive hearing. 
3.9 
Once the matter has been listed for substantive hearing, Listings will 
notify the parties of the date and time.
