27. Give info about monitoring compliance with license requirements and conditions
Monitoring of compliance by the licensee with licensing requirements and conditions is carried out by the licensing authority in the manner prescribed by law.The licensing authority, when exercising control over the observance by the licensee of licensing requirements and conditions, within its competence, has the right:
to require tourism entities to comply with tourism laws;
conduct in the manner prescribed by law, scheduled inspections of compliance by licensees with license requirements and conditions;
to carry out, in the manner prescribed by law, short-term checks of the licensee's compliance with licensing requirements and conditions by decision of a specially authorized body - the Republican Council for the coordination of the activities of regulatory bodies based on complaints from individuals and legal entities about violations of the law;
request and receive from the licensee the necessary information on issues arising from conducting inspections of compliance with license requirements and conditions;
draw up acts (certificates) based on the results of inspections indicating specific violations by the licensee of license requirements and conditions;
to make decisions obliging the licensee to eliminate the revealed violations, to set the deadlines for eliminating such violations;
in cases established by law, make decisions and / or apply to the court regarding the suspension, termination or cancellation of licenses;
in accordance with the established procedure, send materials to the relevant authorities on revealed facts of the implementation of tourist activities without a license for taking measures provided by law.
28. Give info about suspension , termination, and cancelation of license
Suspension or termination of a license, revocation of a license shall be carried out by the licensing authority in cases and in the manner provided for in Articles 22 , 23 and 24 of the Law of the Republic of Uzbekistan “On licensing of certain types of activities”.
A one-time gross violation of licensing requirements and conditions, giving rise to termination in the prescribed manner of a license, includes:
the provision of tourism services without an appropriate agreement concluded with a client or a foreign partner;
the licensee does not have a system of ensuring safety for the life, health and property of tourists and sightseers in the provision of tourist services, confirmed by a certificate of conformity of tourist services;
the absence of a specialist licensee when providing tourist services with a diploma of higher or secondary special, vocational education in the field of “tourism”, or a valid qualification certificate issued for a period of 3 years in the manner established by the licensing authority.
