BOONSBORO MAYOR AND COUNCIL
REGULAR MEETING MINUTES MONDAY, NOVEMBER 3, 2014
The Mayor and Council of Boonsboro held their Regular Meeting on Monday, November 3, 2014 in the Eugene C. Smith Community Center. In attendance were Assistant Mayor Howard Long, Council Members Janeen Solberg, Barbara Wetzel, Sean Haardt and Brigitte Schmidt. Also present were Town Manager Megan Clark, Police Chief Charles Stanford and Administrative Assistant Kimberly Miller. The meeting convened at 7:00 PM with the pledge and the invocation offered by Assistant Mayor Long.

Motion by Council Member Wetzel, second by Council Member Schmidt to approve the October 6, 2014 Regular Meeting Minutes, and motion carried.

Motion by Council Member Solberg, second by Council Member Wetzel to approve the October 6, 2014 Regular Meeting Executive Session Minutes, and motion carried.

Motion by Council Member Schmidt, second by Council Member Haardt to approve the October 27, 2014 Workshop Meeting Minutes as amended, and motion carried.

Motion by Council Member Wetzel, second by Council Member Solberg to approve the October 2014 Treasurer’s Report, and motion carried.

INTORDUCTION OF NEW EMPLOYEES – Chief Stanford.
Aaron Taylor – Chief Stanford introduced the newly hired Police Office and performed the Boonsboro Police Officer Swearing in Ceremony
Donna Burcker – Chief Stanford introduced the newly hired Police Administrative Specialist

Frances Lynch, of 4 Schoolhouse Court, announced that she attended the American Conservation Film Festival in Shepherdstown, West Virginia this past weekend and viewed a film about recycling building materials and suggested that the Town look into starting a program like that. She also asked that the Police Department focus on giving tickets to motorists who text and drive.
MAYOR AND COUNCIL MEMBER COMMENTS AND CORRESPONDENCE
Assistant Mayor Long:

Stated that the Washington County Chapter of the Maryland Municipal League meeting will be held in Clear Spring on November 24, noting that this is also the Legislative meeting.

Stated that he escorted Bruce Wall and his wife for a tour of Boonsboro on November 1.
Council Member Schmidt:

Stated that there are 2 birth announcements from the Environmental Commission. Commission Members Amanda Whitmore and Anthony Dowell each welcomed babies to their families.

Stated that Burkittsville will be hosting a Green Initiatives event.

Stated that George Messner provided a recycling report from Boonesborough Days, noting that there has been a significate reduction in tipping fees over the past 2 years.
Council Member Solberg:

Stated that she would like to request that Apple Valley Waste provide cardboard recycling bins for the Carnival and Boonesborough Days.
Council Member Wetzel:
-
Stated that the Environmental Commission discussed holding ‘recycle days’ throughout the year rather than just having the Spring and Fall Bulk Clean-Up Days.

Stated that the Town received a check for $644.40 from recycling 7,160 pounds of metal from the Fall Bulk Clean-Up event on October 18
Police Department Report – Chief Stanford. The Police Department received 274 calls for service, which included 95 motor vehicle violations for the month of October 2014. There was one (1) adult criminal arrest for an FTA warrant, zero (0) adult traffic arrests, and zero (0) juvenile arrests. Police Department participated in the Town’s Trick-or-Treat night as well as the Boonsboro High School Homecoming Parade. Chief Stanford and Office Pitsnogle attended the Glock Armorer School in October, and Administrative Specialist Burcker attended the UCR Training.
NEW BUSINESS
Ordinance 2014-04; Amendment to the Sewer Ordinance: Industrial Surcharge: Assistant Mayor Long stated that a Public Hearing was held at 6:45 PM for public input on Ordinance 2014-04; Amendment to the Sewer Ordinance: Industrial Surcharge, with no comments being made. Town Manager Clark reviewed that Ordinance 2014-04; Amendment to the Sewer Ordinance: Industrial Surcharge will provide the means to regulate excess grease and excessive discharge of pollutants into the public sewer system, noting that this Ordinance is primarily for Commercial Sewer Users. Motion by Council Member Wetzel, second by Council Member Solberg to approve Ordinance 2014-04; Amendment to the Sewer Ordinance: Industrial Surcharge, and motion carried.

Council Member Wetzel stated that Town Manager Clark needs to be appointed as the Acting Town Clerk until a new employee is hired and the vacant Town Clerk position is filled. Motion by Council Member Wetzel, second by Council Member Schmidt to appoint Town Manager Megan Clark as the Acting Town Clerk, and motion carried.
Resolution 2014-05; Industrial Surcharge Fee: Town Manager Clark stated that Resolution 2014-05; Industrial Surcharge Fee enacts the service charge for excess grease and the excessive discharge of pollutants into the public sewer system as noted in Ordinance 2014-04; Amendment to the Sewer Ordinance: Industrial Surcharge. She stated that upon discovering an excessive amount of grease or other pollutant by the TVing of a sewer line, Resolution 2014-05 will enable the Town to request the monitoring of the lines and the enacting of a monthly Industrial Surcharge Fee until the discharge limits return to the allowable limits of waste as stipulated in the Sewer Ordinance. Motion by Council Member Wetzel, second by Council Member Schmidt to approve Resolution 2014-05; Industrial Surcharge Fee, and motion carried.
Introduction of Ordinance 2014-05; MWQFA Loan Deferment: Town Manager Clark presented the Introduction of Ordinance 2014-05; MWQFA Loan Deferment, a required MDE regulation for the 3-year WWTP loan deferment. She reviewed that MDE agreed to defer the principal payment on the MDE Construction Loan for the WWTP for a 3-year term, noting that the Town would still be responsible for interest payments during the deferment period. Motion by Council Member Haardt, second by Council Member Solberg to approve the Introduction of Ordinance 2014-05; MWQFA Loan Deferment and the scheduling of the Public Hearing at 6:45PM on December 1, 2014 before the Regular Meeting, and motion carried.
Snow Plow/Sidewalk Clearing Proposal: Town Manager Clark stated that the RFP for additional snowplowing and sidewalk clearing for the 2014-2015 winter season was advertised in the Herald-Mail Newspaper and the Town website, with proposals due by October 22. She stated that only one (1) bid proposal was received from Custom Landscape Management with the rate of $90 per hour for snow plowing and $40 per hour for sidewalk clearing. She further stated that the company meets all of the insurance requirements, will be used on an as-needed basis, and that Public Works Supervisor Greg Huntsberry is recommending the approval of their bid proposal. Motion by Council Member Wetzel, second by Council Member Haardt to approve the bid proposal from Custom Landscape Management for the additional snowplowing and sidewalk clearing for the 2014-2015 winter season, and motion carried.
2015 Event and Meeting Calendar: The Council reviewed the 2015 Event and Meeting Calendar at the October Workshop meeting. Administrative Assistant Miller stated that she made the requested edits and corrections to the calendar. Motion by Council Member Solberg, second by Council Member Schmidt to approve the 2015 Event and Meeting Calendar as presented, and motion carried.
Waste Water Treatment Plant Debt Transfer: Town Manager Clark stated that she is requesting the transfer of funds from the General Fund to the Waste Water Treatment Plant Construction Account to cover the USDA WWTP Debt Service Loan payment of $79,501, due November 26, 2014. She stated that there is currently $11,858 in the WWTP Account and that she is requesting the transfer of $68,643 to cover the additional funds need for the USDA payment. Motion by Council Member Wetzel, second by Council Member Haardt to approve the transfer of $68,643 from the General Fund to the Waste Water Treatment Plant Construction Account for the November 2014 USDA WWTP Debt Service Loan payment which will be reimbursed to the General Fund at a later date, and motion carried.
Municipal Government Works Month Proclamation: Assistant Mayor Long read the Proclamation proclaiming November as Municipal Government Works Month in accordance with the Maryland Municipal League. Motion by Council Member Schmidt, second by Council Member Haardt to proclaim November 2014 as Municipal Government Works Month, and motion carried.
COMMISSION REPORTS
Public Safety Commission – S. Haardt. Stated that no meeting was held during the month of October 2014.
Park Board –C. Kauffman. Meeting held on October 22, 2014. Discussions included the stream buffer tree planting with the Antietam Creek Watershed Alliance and Chesapeake Bay Foundation on October 26, the joining of the Maryland Park and Recreations Association, ideas for the use of the Fiscal Year 2016 POS funds, and the plans for Olde Tyme Christmas on December 5 at 6PM.
Utilities Commission –B. Wetzel. Meeting held on October 9, 2014. Discussions included the request to obtain 3 quotes for the Millpoint automatic flusher for the Spring of 2015, an update of the I&I Project priorities on the TT&K property, the approval to forward the Boonsboro-Keedysville MOU for the Booster Pump Station to the Mayor and Council, the approval to adjust the September Water/Sewer bill for Weis Market due to a large leak, and Project Updates for the Maple Avenue Waterline and Sycamore Run Development.
Planning Commission –H. Long. Meeting held on October 23, 2014. Attorney Wantz attended the meeting to discuss community propane tank systems in regards to the Sycamore Run Development and franchise agreements. Other discussions included the approval of the Plan Change to incorporate a community propane tank farm and distribution line contingent upon engineering comments being addressed, permitting requirements being met from the Fire Marshal’s Office and the Mayor and Council entering into a Franchise Agreement that includes consumer protection, the request from Town Manager Clark to hold an informative meeting for the residents of South Main Street near the Sycamore Run entrance to voice their concerns about the alignment changes to South Main Street, and updates on the status of the Easterday Development.
Economic Development Commission –J. Solberg. Meeting held on October 22, 2014. Discussions included an update on the Networking Breakfast held on September 19 at Vesta Restaurant, with guest speaker Casey Willson of the Small Business Development Center Network, joining the CVB at the cost of $185 for membership, the Welcome Sign construction and design of an exterior Town Annex sign, the Holiday In Boonsboro event on December 6, and the suggestion to become a member of the Hagerstown/Washington County Chambers of Commerce. The next EDC meeting will be held on December 17 at 9AM in the Town Annex and the next Networking Breakfast will be held on November 21 at 7:30AM at Vesta Restaurant.
Environmental Commission –B. Schmidt. Meeting held on October 8, 2014. Discussions included the Town Farm Stream Buffer Tree Planting Project scheduled for October 26, the Subcommittee Reports and Town updates.
Town Manager’s Report – M. Clark.

Stated that a new law was passed requiring Apartment and Condominium Associations with over 10 units to provide recycling

Stated that the Stream Buffer Tree Planting on October 26 was a success

Stated that the Public Works staff is now working their Winter schedule of 7AM until 3:30PM

Stated that Town will be charged the LED Rate for the decorative streetlights along Main Street beginning on November 15
-
Stated that the new Town Hall hours are 8AM until 4:30PM

Stated that the Town Audit presentation will be held at the November Workshop meeting

Stated that Water/Waste Water Operator Pete Shumaker successfully completed his certification for Superintendent

Stated that she attended the LGIT Annual Conference and will be attending the Sustainability Training on November 20
-
Stated that the last day for Monday Yard Debris Pick-Up is November 17 and that the last day for the Yard Debris Site is November 22, at which time the site will be open on the third Saturday throughout the Winter months

Stated that Town Hall will be closed on Tuesday, November 11 for Veteran’s Day

Stated that Town Hall will be closed on Thursday, November 27 and Friday, November 28 for the Thanksgiving Holiday
Motioned by Council Member Haardt, second by Council Member Wetzel to close the meeting at 8:45 PM and move into Executive Session; as permitted under Maryland State Article §10-508 (a) Section (1) to discuss the appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, or performance evaluation of appointees, employees, or officials over who this public body has jurisdiction, and §10-508 (a) Section (7) to consult with staff, consultants, or other individuals regarding a legal matter, and motion carried.
