The documents should not use obsolete words and expressions (archaisms and historicisms), although this is inherent in English legal texts.
The main requirement for the information saturation of the document is the expedient amount of the included communicative task - to convince, induce, attract attention, express disagreement, and so on. The redundancy, heterogeneity of the information included in the document makes it difficult to perceive, and therefore reduces its effectiveness.
1.3. Legalese, or Legal Language
Legalese is an English term that is commonly used as a synonym for legal writing style. "This is a special legal language, a special way of constructing phrases and sentences, which for those who are ignorant of the intricacies of English legal terminology, often seems devoid of meaning."7
Legalese is more precise and less ambiguous than conventional English. However, often texts written in the legalese style contain such cumbersome and ornate constructions that they become even more ambiguous than those written in common language.
Another argument in favor of legalese is that the need to provide for all possible situations in this case is more important than brevity of formulations and brevity of presentation. "The use of cumbersome legal constructions is conditioned by the need to accurately define legal phenomena." Legal terminology should be clear and language should not be vague or ambiguous. Otherwise, "legal loopholes" – лазейки, пробелы в законодательстве. "Moreover, there are still a huge number of documents and precedents that were drawn up in the legalese style and which are still the source of English law. Rewriting , adapting documents is a very difficult and long-term task, and if you have to change the style of presentation, then this process can be delayed two or three times. At the same time, it is often "difficult to preserve and absolutely accurately convey the semantic meaning embedded in a particular phrase or word without resorting to the help of legalese. English legalese has the following features:
1. the use of words and expressions that do not carry any semantic load in the usual, everyday sense. However, inlegalese they have a specific meaning.
2. the use of words and expressions that, in addition to the usual, everyday meaning, also have a special legal meaning, in particular:
consideration (valuable consideration) - встречное удовлетворение; один из необходимых элементов договора для того, чтобы тот мог быть принудительно осуществлен в судебном порядке.
3. the use of formal vocabulary, which is considered obsolete and very rarely used in everyday communication:
hereinafter - далее по тексту, в дальнейшем;
aforesaid - ранее упомянутый.
4. construction of very long sentences, containing a large number of turns, supplementing or characterizing the original statement
5. frequency of use of modal verbs such a shall, will:
“[…] the generality of subsection above shall not be taken to be prejudiced by any enactment […]” or “[…] he shall be removed from office as a justice of the peace in accordance with section 6 of this Act [… ]".
6. an abundance of passive structures:
"It may be true that such parts of the common law […] are based upon, or (are) consistent with, ideas and values […]".
