TOWN COUNCIL

REGULAR MEETING

JUNE 14, 2016

CITY HALL, SUNBURST MT 59482



IN ATTENDANCE: Mayor Gary Iverson, Council persons Holly Hovland, Shane Berthelote, Tim Tharp, Mike Tobin, and employees Roxanne Moore, and Phil Iverson.
Also in attendance: Linda Burley, Harriet Karst, Dottie Moss, William Moss, Dan Kimmet, Randy Fauque and John MacDonald
ABSENT: none
Meeting was called to order at 6:58 pm.
MINUTES: Council and Mayor made corrections to minutes. Mike Tobin moved the minutes be approved as modified. Shane Berthelote seconded and motion carried unanimously.
PUBLIC COMMENTS:
John McDonald: Pat Henricks is coming the week of June 20-24. Pat sent his crew up this week (June 13-17) for maintenance around the wells. Sent out the newsletter last week (June 6-10). Pat and his crew are waiting to hear back from DEQ. Chevron reached an agreement with John Simms. Someone inquired about access to Dangerfield’s old place, which has been fenced off for liability measures. Some are using it as a walking area. Chevron wants the property to be closed because of safety issues and liabilities. Round up needed for weeds at the Old Ryan house. John will let Pat know about the weeds and have the crew take care of them. Mayor Iverson will research waterline.
Randy Fauque: Regarding Swayze Waterline, Randy is in negotiations with Chevron to move the line. The line goes through the superfunds site and do not want it to go through the superfunds site. Chevron needs to move it and want to move it to the east side of the highway, connect on by the Border Patrol station, run it up by KW Insurance, and then feed both ways back, shut it off by Hout’s, and not allow it to go through the superfunds site. The problem is an engineer needs to be hired and we need to determine who owns the line. If Sunburst owns the line, then it is on the town to follow up with the suit and pay the engineer to get the process going on the waterline. If the Swayze group own the waterline, then it is their responsibility. A determination needs to be made. Mayor Iverson is going to research when Texaco deeded the waterline to the city and speak with William Hunt.
OLD BUSINESS:
Creation of a Special Pool Maintenance District: No news
2016 All Class Reunion: Dan Kimmet has 500 plus people signed up so far for class reunion. Randy inquired about streets to be patched. Legion club is setting up a beer garden next to the Mint bar. Lions club is doing a breakfast. Randy Fauque will be spraying for weeds around town.
Revisions on the Personnel Policy: Holly Hovland followed up with Roxanne Moore regarding a pumping station for after she has her baby. They created a plan to use the back room and set up a table with a chair. Personnel Policy will be updated to reflect the plan for new mothers. The council is still reviewing the personnel policy and will be placed on July’s agenda.
Social Media: Council is thinking about creating a Facebook page more focused on town business, news and updates. Social media will be placed on July’s agenda.
NEW BUSINESS:
Resolution Roxanne’s participation in STIP: Council reviews, Tim Tharp motions to move and pass Resolution 521. Holly Hovland seconds and motion is carried unanimously.
Anita Swenson’s Well: Phil met with Anita and the well has been fenced. Anita came to town hall and said that it is resolved. Rim Rock is fenced too.
Street Improvement Plan: Product was not available last year. Easystreet is the product used to patch streets. The town has money for the patch work on streets. Crew are working on the streets but have had some other priorities to work on before streets. Crew is patching as fast as they can but rain can hinder the crew. Phil said he will have 1st Avenue West and 4th Avenue West repaired before the reunion. Harriet inquired about the accounting for the SID. Mayor Iverson explained that the SID was for 10 years and in five year increments. The amounts come to $66,000.00 a year for 10 years. The SID money goes to pay the loan. The first five years most of the money went to the valley gutters. The second five years went to the chipseal. Streets were Re-chipsealed five years ago and need to be re-chipsealed. In order to do so the SID must be extended for another five years to pay for the work, which requires a hearing and a protest. Rita asked about the Gas Tax and Mayor Iverson explained the Gas tax goes to pay for the SID. Phil will inquire about coordinating and preordering Easystreet mix. Mike Tobin asked Harriet if she still wanted to see the accounting and she replied “No, I see where the money is going”. Harriet asked to see the Audit and was welcomed to see it any time as it is always available at the City Hall of Sunburst.
Construction/Excavation Permits: Mayor Iverson would like to edit the current street ordinance for the Town of Sunburst so it reads if companies need to rip up the street they are held liable to fix the street. Mayor Iverson and the council will see how they can implement the new idea for the ordinance. Linda Burley will send the Town of Cut Bank’s ordinance to Mayor Iverson.
Tim Tharp’s Resignation from Town Council: Mayor Iverson thanked Tim Tharp for his service to the council. Shane Berthelot accepts Tim Tharp’s resignation, Mike Tobin seconded the motion, and motion carried unanimously.
Town Council to Appoint New Council member: Individuals interested were not present and will be contacted for
COUNCIL DISCUSSION OF ITEMS NOT ON AGENDA:
Roxanne’s Position: Following the Council discussion, Council approved Roxanne living in Sweet Grass and remain the Clerk-Treasurer.
Mosquitos: MSU sent out email regarding mosquito sprays. The concern is that the mosquito sprays are killing other insects such as bee’s. Mike Tobin suggests residents to use Cutters mosquito spray, which attaches to a hose, and easy to spray on their landscape. Plus, Phil sprays the mist mosquito spray in the neighborhood and both of these can help eliminate the production of Mosquitos. Holly asked Phil if the chemical used in the neighborhood kill other insects too. Phil replied that the chemicals are safe for the other insects.

Mow Notices: Holly Hovland asked about mow notices on problem properties. Mayor Iverson explains that notices go out when complaints come in, and if the situation is not resolved the resident is charged $100.00, in which the crew mow’s the lawn.
VENDOR REPORTS: Claims list and payroll were reviewed. Mike Tobin motioned to accept, Holly second the motion, and motion carried unanimously. Approved were Claims 2535, 2536, 2539, 2540, 2541, 2543, 2544, 2546, 2548, 2549, 2556 -2569.

Hearing no objections, the meeting was adjourned by Mayor Iverson at 8:35pm.


The next regular meeting will be held on July 11, 2016 at 7:00 pm.
