95 EVERYMAN’S RIGHT
Everyman’s right is an ancient custom, based on tradition and to some extent national laws, which allows free 
access to land and waterways regardless of who owns the land. The sparse population of Finland and the other 
Nordic countries has provided a fertile soil for everyman’s rights to develop from a system based on customary 
law to one encoded in the judicial system. This is in contrast to many other European countries, e.g. Belgium 
and England, where being on someone else’s land is a criminal offence. 
The most traditional everyman’s right is probably the right to walk on other people’s land. Walking, skiing or 
cycling across the countryside does not therefore require the landowner’s permission. 
The various everyman’s rights have some features in common; no fees may be charged, and any incursion 
should be harmless and generally temporary, which means that roaming must cause as little disturbance as 
possible. Everyman’s right to walk, ski or cycle does not apply to gardens or fields, which may not be traversed, 
and permission is always required for motor sledging. Organised e.g. skiing or orienteering competitions are not 
generally covered by everyman’s rights, so an agreement with the landowner is necessary. 
The particular regulations that apply to access to waterways are encoded in the Water Act. In principle any 
kind of vehicle may be used, and access is also permitted to frozen waterways. In certain areas there has been 
friction between people using jet-skis or noisy boats (e.g. for water skiing) and locals who live on the shore. This 
has been mainly caused by repetitive use too close to the land. In the ongoing reform of the Water Act it has 
been proposed that shoredwellers should be 
granted more protection by extending the penal code’s provisions 
on domestic peace to apply to areas of water which are directly attached to a dweller’s yard. 
Temporary camping for one or two days is a wellknown everyman’s right, but lighting an open fire requires 
the landowner’s permission. The camper is obliged to avoid creating any disturbance or nuisance and to observe 
the general prohibition on littering. Even the short-
term parking of caravans requires the landowner’s permission 
as a motor vehicle is involved. 
Another typical everyman’s right is the right to pick wild berries, mushrooms and flowers from anywhere that 
walking is permitted. More than half of Finnish households gather wild berries, and around 50 million kilos are 
picked annually. Some plants are however protected by the Nature Conservation Decree. Water may be drawn 
from waterways for household use and for e.g. animals, but taking soil from the bottom of waterways or 
elsewhere is prohibited. 
Rod and baited hook fishing and ice-fishing are 
everyman’s rights which are specifically prescribed in the 
fishing legislation. Approximately 40% of the population, i.e. 2 million people, participate in some kind of fishing 
event at least once a year. 
Everyman’s rights are generally accepted in Finland and have become established without comprehensive 
legislation. The rights attached to this ancient social innovation are not enjoyed by Finnish citizens alone, but

also apply equally to anybody visiting our country.
