Complaint Resolution Mandate
For the East Stroudsburg Area SD
Introduction
The No Child Left Behind Act of 2001 (NCLB) legislation requires Local Education Agencies (LEAs) to adopt a set of written procedures for “receiving and resolving any complaint alleging violations of the law.” In accordance with this Federal mandate, the East Stroudsburg Area SD has adopted the following
Policy.
Definition
A “complaint” is a written, signed statement filed by an individual or an organization. It must include:

A statement that the Pennsylvania Department of Education or the Local Education Agency has violated a requirement of the federal statute.

The facts on which the complaint are based.

The dates of any discussions, meetings, or correspondence with PDE or the LEA regarding the complaint.
East Stroudsburg Area School District Complaint Procedures
1. Referral- Complaints against the East Stroudsburg Area School District will be received by the Building Administrator. The complaint must be written and signed by an individual.
2. Acknowledgment – The Building Administrator will acknowledge receipt of the complaint, in writing
within 15 calendar days and secure documentation thereof.
3. Investigation - The Building Administrator will investigate the complaint and attempt to resolve it informally. If an informal resolution is reached, no further investigative action by the District is necessary. If the complaint cannot be informally resolved, the Building Administrator will refer the complaint to the Superintendent and secure documentation for the date it was sent.
4. Presentation of Evidence - The Superintendent at his/her discretion, will provide an opportunity for the complainant and/or the complainant’s representative to present evidence. Either party reserves the right to question or dispute the evidence.

5. Report of Recommended Once the Superintendent has completed his/her investigation of the
Resolution - complaint, he/she will complete a written report within 15 calendar days,
with a recommendation for resolving the complaint and secure documentation thereof.
This report will include but not necessarily be limited to:

The name of the party filing the complaint

The general nature of the complaint
-
A summary of the investigation

The recommended resolution and justification for such

A copy sent to the Building Administrator and the Complainant
6. Appeal - The complainant may appeal the Superintendent’s recommended resolution to the Commonwealth of Pennsylvania Department of Education.
7. Follow-Up - The Building Administrator will be responsible to carry out the complaint resolution recommendations.
8. Time Frame - The period between the East Stroudsburg Area School District’s receipt of the signed, written complaint and its resolution shall not exceed 45 calendar days.
