gather data proof in the case of a cybersecurity incident and whether that evidence will be 
admissible in court. 
In terms of contracting, the company should insist on clarity on the information security 
criteria that the provider must follow. The company should also be able to assess and audit the 
supplier's adherence to contractually stipulated obligations. Furthermore, the contract should 
explicitly describe the circumstances under which the supplier is liable for a cybersecurity 
incident, the degree of their financial culpability, and what expenditures the firm may be able to 
cover. 
Big industry contributes to enhanced cyber resilience 
To lessen the potential of assaults, the majority of large corporations use organizational, 
employee-related, and technical security measures. Furthermore, when it comes to connected 
devices, many German enterprises follow the "security-by-design" philosophy. As a result, they 
provide clients extremely cyber-resilient products and services. 
Everyone engaged – from hardware and software makers to commercial operators, individual 
users, and government agencies – must work together to increase cyber-resilience. Because a 
high level of cyber-resilience is a key condition for the trouble-free operation of extensively 
digitalized processes in businesses, European industry will continue to contribute to this. At the 
same time, national and European legislators must provide enterprises with a legislative 
framework that improves Europe's cyber-resilience while meeting business demands. 
Furthermore, in the sphere of cyber security, tight collaboration between public and private 
entities is critical. In this regard, the Alliance for Cyber Security, founded in 2012, is a 
successful model for fostering collaboration among state and non-state (commercial) actors. The 
Alliance for Cyber Security provides its members with up-to-date information on the state of IT 
security, as well as a variety of events for the sharing of knowledge and best practices, as well as 
a comprehensive range of consultancy and support services. Several thousand businesses and 
organizations, including the Federation of German Industries (BDI), have already signed on to 
the effort, and the number is growing.
