Islamic banks can provide financing by way of a
Salam
contract by entering into two
separate
Salam
contracts, or one
Salam
contract and an instalment sales contract. For example,
the bank could buy a commodity by making an advance payment to the supplier and fixing
the date of delivery at the client’s desired date. It can then sell the commodity to a third
party either on a
Salam
or sale by instalments basis. If the two were both
Salam
contracts,
the second contract known as a Parallel
Salam
contract, would be for delivery of the same
quantity and description as that constituting the subject matter of the first
Salam
contract. This
second contract would be concluded after the first contract, because its price has to be paid
immediately upon conclusion of the contract.
To be valid from the
Sharia’a
point of view, the second contract must be independent (or
not linked to the delivery in the first contract). If the second contract consists of a sale by
instalments, its date should be subsequent to the date on which the bank would receive the
commodity.
9.2 WHAT MAKES
SALAM SHARIA’A
COMPLIANT?
To explain why
Salam
is
Sharia’a
compliant, it is necessary to refer to the
Ahadith
to explain
the evidence of legality.
Salam
is a kind of debt because the subject of the
Salam
contract is the liability of the seller
up to the due date, and so its permissibility is subsumed in the following verse:
O ye who believe! When ye deal with each other, in transactions involving future obligations in a
fixed period of time, reduce them to writing.

In addition, the Prophet said:
He who sells on
Salam
must sell a specific volume and a specific weight to a specific due date.
All the Muslim jurists are unanimous regarding the principle that
Salam
will not be valid
unless all the
Sharia’a
conditions are fully observed, because they are based on the express
Aha-
dith
of the Prophet. The most famous
Hadith
in this context is the one which the Prophet said
Whoever wishes to enter into a contract of
Salam
, he must effect the
Salam
according to the
specified measure and the specified weight and the specified date of delivery.
There is consensus among Muslims on the permissibility of
Salam
due to the practical need
for it and because the commodity in the contract is a recompense for the price paid in advance.
The commodity to be delivered is similar to the price in a credit sale and so it is considered to
be an affirmed liability, and thereby acceptable under the
Sharia’a
.
