5. FORCE MAJEURE


5.1. The Parties shall not be liable for the failure or improper performance of their obligations arising from this Public offer if their proper execution is not possible due to force majeure circumstances: natural disasters, strikes, civil unrest, wars or any other circumstances beyond the control of the Parties, including due to changes in the legislation of the Republic of Uzbekistan or the issuance / acceptance of acts / instructions by the Central Bank of the Republic of Uzbekistan.


5.2. The Bank shall not be liable for this Public offer in the following cases:
- If there are possible failures in the interbank electronic payment system;
- Delays in payment due to the fault of the Client, as a result of inaccuracies committed by the Client during the formalization of documents;
- Arrest and/or suspension and /or freezing of operations on the accounts of the Bank or the Client in accordance with the procedure established by law;
- If it is impossible for the Bank to fulfill its obligations under the Public offer for reasons beyond the control of the Bank and in the event of force majeure;
5.3. The Bank shall not be liable for the dissatisfaction of the Applications for reasons beyond the control of the Bank.
6. CONFIDENTIALITY


6.1. The Parties are obliged, in accordance with the Public offer, to keep confidential and not disclose in any way to any third parties confidential information that has become known to them as a result of the conclusion and implementation of this Public offer.


6.2. Confidential information received by the Party prior to the signing of this Public offer, information obtained by lawful methods from other sources, as well as information that cannot be confidential in accordance with the current legislation of the Parties is not confidential.


6.3. In case of necessity to provide or disclose confidential information at the request of an authorized state body, to which the right to request the provision of confidential information is provided by law, the Party is obliged to preliminary notify (prior to the provision of confidential information) the Party in writing or verbally that provided this information.
6.4. Obligations to ensure the protection and non-disclosure of the confidential information received are valid for the duration of this Public offer.
