should “unite these services into a complex”. Tourist laws provide for compensation 
of damage if a tourist is injured or personal property is damaged. In accordance with 
the Directive, this type of responsibility arises in case of guilt. However, as the 
burden of proof is distributed, the proof of guilt protects a tourist.
In accordance with German laws, there are no public authorities that supervise 
the tourism industry. The industry operates in accordance with the provisions of the 
law on consumer rights protection. Instead of this, consumers are stipulated to form 
groups when going to court. The Federal Court of Justice of Germany issued a number 
of rulings with regard to conventional terms of agreements in the tourism industry under 
consumers’ class lawsuits, especially regarding payment terms.
