LEASE CONTRACT

between the Marienheim, ecclesiastical foundation, Katharinenstr. 4, 70182 Stuttgart

the following lease contract will be concluded:



§ 1

Rental object

The lease of the un/furnished single room no. …… on the …… floor of the building Katharinenstraße 4, 70182 Stuttgart is for residential purposes only. The living space holds ………. m².

The lessor provides common rooms (kitchenettes, bathrooms and laundry room). The lessee can use these according to their purposes.

1. The lessee obtains the following keys when moving in: 1 transponder for the entrance door, 1 key for room and letter box, 1 key for the refrigerator and 1 for the kitchen cupboard. The production of spare keys is prohibited, keys are not to be passed on to unauthorised persons. The loss of a key or transponder is to be reported immediately to the house management and the caretaker. The lessor is entitled to change the corresponding door locks and to provide the needed spare keys at the expense of the lessee.

2. Moving in a handover certificate with a list of inventory will be filled out and signed by the two parties of this contract. It forms part of the contract.

§ 2

Rent and additional costs

1. The monthly rent sums up to:

3. The lessor is authorised to appropriate rising costs to the lessee. The lessor is entitled to allocate rising additional costs pro rata to the lessee if she is notified by a written statement and respecting the consideration of the statutory provision.

§ 3

Form of payment

1. The rent and the flat charge of the additional costs are respectively due until the third working day of each month. The rent is to pay via a direct debit authorisation. The lessee grants the lesser with a direct debit authorisation, which is attached to the lease contract.

2. The lessee is admonished to provide the appropriate covering on the stated account. The costs for a returned debit note have to be covered by the lessee.

§ 4

Term of lease and residential authorization

1. The accommodation unit is let for temporary use and the special purpose of low-priced accommodation for persons who fulfil the requirements of § 53 of the German federal fiscal code and are exclusively let to the personal use of the lessee.

The letting starts from …….. and is undetermined.

§ 5

Cancellation

1. The letting ends with the termination of the lease period agreed upon in the contract or by a written cancellation.

2. A cancellation within the lease period can only be handed in until the third working day of the month to the end of which the contract is being cancelled.

3. The cancellation of the contract needs to be carried out in a written form. The timeliness of the cancellation does not depend on the date of the posting but on the arrival of the written cancellation.

4. The lessor can cancel the letting without taking into account the period of notice if the lessee

a) is in delay with the rent on two consecutive dates or with a not insignificant part of the rent or is in delay with the rent in a time span longer than two months added up to an amount that equals the sum of two rents.

b) uses the rental property or the common rooms contratry to contract regardless of a dissuasion by the lessor, especially when the rental property is left to an unauthorized person.

c) severely breaches the lease contract, the house rules or the domestic rules.

d) cannot verify the residential authorization according to § 4.

5. After the termination of the lease contract a renewal by tacit agreement is impossible.



§ 6

Maintenance and repair – liability for damages

1. The lessee has to account for the cleaning of the single room.

2. The costs for the maintenance and repair of the single rooms are paid for by the lessor, provided that the damage has not been caused in negligence by the lessee or access admitted authorized persons.

3. The lessor provides the cleaning of the circulation area and the common rooms. The costs for this are included in the flat charges of the additional costs.



§ 7

Aesthetic repairs

1. The aesthetic repairs of the single rooms have to be carried out by the lessee. By moving out the lessee is obliged to make up for necessary or not yet accomplished aesthetic repairs.

2. Generally aesthetic repairs (painting works on ceilings and walls, cleaning of the floor covering) become necessary in the following intervals:

Kitchens, showers, bathrooms: 3 – 4 years

Living space: 5 – 6 years.

§ 8

Subletting

1. Without the permission of the lessor the lessee is not allowed to let third persons use the rented object, notably to sublet it to third persons. If the lessor denies his permission the lessee can cancel the lease contract within the respite as long as no serious reason lies in the third person.

2. Does the lessee sublet the room to a third person the lessee has to stand in for the caused default by using produced by the third person even if the lessor gave his/her permission for the cession.

§ 9

Keeping of animals

The keeping of animals (also of small animals such as birds, mice, rats, guinea pigs, turtles, snakes, rabbits etc.) in the Marienheim is not allowed due to hygienic and security reasons. Furthermore it cannot be permit to keep animals because of the very dense occupancy (108 rooms!) as well as the limited living space. Violations lead to the cancellation of the letting.



§ 10

Defects

1. If defects emerge during the time of the lease or precautionary measures become necessary to protect the rental property from unforeseen dangers, the lessee has to notify the lessor immediately. This also applies if a third person claims rights for the object.

2. If the lessee omits the notification she is obliged to compensate for the resulting damage. If the lessor was not able to provide repair because of the omitted notification, the lessee is not entitled to plead for her rights according to § 537 BGB (German Civil Code) and § 542, Abs.1, Satz 3 BGB to cancel without an appropriate time limit or to charge compensation for default.

§ 11

Entering the rental property

1. The lessor or by him authorized representatives may enter the rental property to check upon its condition or to maintain the heating or sanitary system in appropriate intervals and after timely notification during common visiting hours. Personal circumventions of the lessee are considered.

2. In case of longer absence the lessee has to provide for the execution of the lessors right of inspection.

3. In case of immediate danger the lessor can enter the rental property without advance notice and during the absence of the lessee.



§ 12

Termination of letting

1. The lessee is obliged to return the lease property after the termination of the letting cleared and in a clean and proper condition. Damages of the lease property caused in negligence by the lessee or her vicarious agent have to be remediated beforehand. If this does not occur the lessor is entitled to repair the damages at the expenses of the lessee.

2. The lessee has to hand all the keys to the lessor when moving out. If this is not possible the lessor is entitled, at the expenses of the lessee, to exchange the corresponding door locks and to provide all the necessary keys.

§ 13

Deposit

1. The lessee is obliged to make a deposit of 500,00 Euros to the lessor as a security for the fulfillment of the obligations arising from the letting.

2. The lessor will invest the deposit in a trustee savings bank or in another bank at a common interest rate with a legal period of notice.

3. The lessor is entitled to withdraw from the deposit already during the letting due to matured claims. In this case the lessee is obliged to raise the deposit to its original amount. During the lease it is impossible for the lessee to count up the claim for the back payment of the deposit with possible outstanding depts towards the lessor.

4. After the termination of the lease the lessor has to settle the deposit and disburse the remaining deposit with all interests. The amount reclaimed by the lessee is due two months after the return of the leased property.

§ 14

House rules

The house information (house rules) in its respectively valid version is part of this contract. It is enclosed and is acknowledged with the signature of the contract. The lesee obliges herself to request her guests staying in the house to abide by the house rules.



§ 15

Other

1. Further agreements to this contract do not exist. Supplements to the agreement were not made. Supplements and changes of this contract must be in written form.

2. The lesee is advised to contract an insurance over her personal properties. Furthermore a liability insurance should exist or be contracted.
