9. ОТВЕТСТВЕНОСТЬ СТОРОН 
defect, just as the fact of discrepancy of the goods with the 
requirements stated in the specified documentation of this 
Contract the BUYER has the right to submit a claim 
(reclamation) to the SELLER within 10 days from the date 
of arrival of goods to the BUYER’s warehouse. To confirm 
the claim, the BUYER has to present the acceptance report 
(survey) issued by consumers or the acceptance report 
(survey) issued with the participation of representatives of 
the expert organization attracted by the BUYER. 
6.2. If the claim is submitted in respect of the quantity or 
quality, the SELLER has to reimburse the cost including the 
expenses incurred by the BUYER
 
within 15 days from the 
moment of obtaining the claim. The Claim on weight 
shortage has to be based on results of weighing the entire 
batch of the goods which has arrived according to one 
transport document (bill of lading/CMR).
 
 
7. GUARANTEES 
 
7.1. The Seller guarantees that the Goods are completely 
matches its description in specification and proforma-invoice 
to present Contract, its earlier confirmed samples. 
7.2. The Seller guarantees that the Goods are neither under 
mortgage, nor arrested, not a subject of pretensions of the 
third Parties, not encumbered any other way and belongs to 
the Seller by the right of property either the Seller has the 
right to manage (handle) the Goods on other legal basis. The 
Seller guarantees legitimate origin of the Goods, lawfulness 
of usage of trademark on the Goods. 
7.3. The Seller guarantees an appropriate quality of the 
Goods during its lifetime period (validity period) shown in 
accompanying documentation considering that the storage 
terms are observed, the cargo operations are properly 
handled. 
7.4. The Seller guarantees compensation of the cost of the 
Goods (including transportation costs, customs payments 
and other expenses) in case of delivery of the low-quality or 
damaged Goods. 
7.5. The Parties guarantee that each has all necessary rights, 
authorities and documents required for concluding and 
executing the present contract.
7.6. The Seller guarantees replacement, or compensation of 
defected goods exceeding 1% of the entire consignment, that 
were discovered during the realization of the goods.
