Indemnification

To the fullest extent permitted by law, Contractor shall indemnify, hold harmless and defend Town of New Castle, its appointed and elected officials, agents and employees of any of them from and against all claims, damages, losses or expenses including by not limited to attorney’s fees arising out of or resulting from the performance of the agreement, provided any such claim, damage, loss or expense (a) is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property, including loss of use resulting there from, and (b) is caused in whole or in part by any act or omission or violation of statutory duty or regulation of the Contractor or anyone directly or indirectly employed by it or anyone for whose acts it may be liable pursuant to the performance of the agreement. Notwithstanding the foregoing, Contractor’s obligation to indemnify Town of New Castle, and agents and employees of any of them for any judgment, mediation or arbitration award shall exist to the extent caused in whole or in part by


a) negligent acts or omissions, or (b) violations of regulatory or statutory provisions of the New York State Labor Law, OSHA, or other governing rule or applicable law; by the Contractor anyone directly or indirectly employed by it or anyone for whose acts it may be liable in connection to such claim, damage, loss and expense. The obligation of the Contractor to indemnify any party under this paragraph shall not be limited in any manner by any limitation of the amount of insurance coverage or benefits including worker’s compensation or other employee benefit acts provided by the Contractor.



LABOR
The Contractor shall comply with the applicable provisions of the “Labor Law” as amended, of the State of New York. This Contract shall be void unless applicable sections of said Labor Law are complied with. Each and every provision of law and clause required by law to be part of this Contract shall be deemed to be included herein and this Contract shall be read and enforced as though it were included herein, and if through mere mistake or otherwise any such provision is not included, then upon the application of either party hereto, the Contract shall forthwith be physically amended to make such inclusion.
Specifically, section 220-e, of the Labor Law, as so amended, prohibits in contracts, discrimination on account of race, creed, color, disability, gender, or national origin in employment of citizens upon public works.
CONSENT OF SURETY
The attention of the bidder is called to the Consent of Surety attached to the itemized Bid Forms. This must be properly filled out by his Surety and submitted with his bid. The Owner reserves the right to reject all bids that do not contain this Consent of Surety properly filled out and attached to his bid on the actual date of the opening of sealed bids.

COMPLETION OF WORK BY TOWN OF NEW CASTLE:
If the work to be done under the contract resulting from this bid shall be abandoned by the Contractor, or if this contract shall be assigned, or the work sublet by him, otherwise than as herein specified; or if at any time the Superintendent of Recreation shall so certify in writing to the Town of New Castle that the Contractor is willfully violating any of the conditions or covenants or this contract, or of the Bid Documents, or is executing the same in bad faith or not accordance with the terms thereof; or if the work be not fully completed within the time named in this contract for its completion, or within the time to which the completion of the contract may be extended by the Town of New Castle, the Town of New Castle may notify the Contractor, as herein provided; and the Contractor shall within five (5) days of the service of said written notice, discontinue the work, or such part thereof, and the Town of New Castle shall thereupon have the power to contract for the completion of the contract in the manner prescribed by law, or to place such and so many persons as it may deem advisable, by contract or otherwise, to work, and complete the work herein described, or such part thereof, to take possession of and use any of the materials, plant, tools, equipment, supplies and property of every kind provided by the Contractor for the purpose of his work, and to procure other materials and equipment for the completion of the same, and to charge the expense of said labor and materials to the Contractor. The expense so charged shall be deducted and paid by the Town of New Castle out of such monies as may be due to, or may at any time thereafter grow due to the Contractor under and by virtue of this contract, or any part thereof. In case such expense shall exceed the amount which would have been payable under the contract if the same had been completed by the Contractor, the Contractor or his surety shall pay the amount of such excess to the Town of New Castle; and in case such expense shall be less than the amount which would have been payable under this contract if the same had been completed by the Contractor, the Town of New Castle shall pay such difference to the Contractor.

INTRODUCTION:
The Town of New Castle is soliciting bids to furnish and deliver one (1) Modular Play Structure for Ages 2-5, one (1) Modular Play Structure for Ages 5-12, one (1) two bay swing set, one (1) 3 bay swing set and assorted Independent Play Features for Gedney Park, 155 Millwood Road, Chappaqua,New York.
SCOPE OF THE WORK:
The bidder shall furnish a detailed play equipment drawing, Two (2) 3-D renderings and an equipment supply list i.e., slide, climber etc.,and furnish pricing for manufacture, supply and delivery of equipment as part of the bid submission.
The bidder shall furnish all labor, materials and equipment necessary and/or required to deliver modular play equipment as specified in the submitted bid. The Town of New Castle is also requesting pricing for the installation of the equipment as noted in the bid sheets as a separate price, and the cost to supply and install safety surfacing..
Design Criteria and Certifications:
Use Zone
A minimum use zone of 6' shall be maintained between any piece of play equipment and a bordering object, including, but not limited to: edging, trees, site amenities, the use zone of other play equipment and/or activities. Use zones shall not overlap.
Age appropriate
Play equipment shall be age appropriate in accordance with IPEMA standards and criteria.


Guidelines
Steel play equipment shall comply with all relevant provisions of the following codes or standards. It is the responsibility of the manufacturer to indicate on the shop drawings, in writing, any and all variations from the following standards:

CERTIFICATION OF EQUIPMENT/DESIGN
A. Bidders must certify that the play equipment designs are in compliance with the CPSC Guidelines, the ASTM Standard F 1487-95, especially Section 9.7.2 concerning circulation patterns and Section 10 on Accessibility, and the intent of the Americans with Disabilities Act.
B. Bidders must indicate whether the equipment manufacturer is registered as an ISO 9001 certified company, which assures that they follow International Standards for Quality Control. If the company is registered, please provide the registration number and the scope of the registration.
C. Bidders must indicate whether the play equipment proposed is IPEMA (International Play Equipment Manufacturers Association) validated by an independent agency, and must show proof of this validation.

Guarantee

The manufacturer shall furnish a written guarantee, covering the replacement of any structurally damaged items or components, at no extra charge for a minimum period of 15 (Fifteen) years.


WARRANTIES
All Play Equipment components shall have a two-year warranty to be free of defects in both workmanship and materials.

Engineered Drawings:
Structure design plans/drawings including the structure footing plan shall prepared by a certified playground planner/installer.
MATERIALS:
MODULAR PLAY STRUCTURES / SWING SET ASSORTED INDEPENENT PLAY FEATURES shall be manufactured by Landscape Structures, Gametime, Little Tykes, Playworld, Miracle Equipment, Kompan or a Manufacturer of equal quality.


Each vendor shall provide a product list as part of their bid proposal that includes the following:


  1. Posts – all posts are to be steel – Posts shall comply with ASTM Specifications: A-315, A-500, and A-513. Vendor to list the following:

    1. Diameter

    2. Gauge

    3. Min. Tensile Strength

    4. Min. yield strength

    5. Painted zinc interior

      1. Baked on Powdercoat finish All support posts shall be finished with baked-on polyester powder coating or an optional application of PrismCoat.




  1. Clamps - die-cast of high strength 380 aluminum alloy or approved equal. Vendor to list the following:

    1. Tensile strength

    2. Fastening mechanism i.e. drive rivet or equal

    3. Powdercoat

3. Decking –

a. MATERIALS • Deck shall be an all-welded assembly fabricated of 12 gauge hot rolled, pickled and oiled flat steel and 1/4" x 3" hot rolled, pickled and oiled flat steel for a back support.

b.Indicate mil thickness of coating

c.Indicate size of support hangers, bolts and locknuts.
4. Rotationally Molded Plastic Parts - Shall be rotationally molded from color-compounded, first quality, linear low density, polyethylene. Dry-blended or molded-in resins are not acceptable. Cross-sectional design shall be .25 in. (6 mm) nominal thickness, double wall construction. ASTM Specifications: D-1238 (Melt Index), D-1505 (Material Density), D-638 (Tensile Strength), D-648 (Heat Distortion Temperature) D-790 (Flexural Modulus), D-1693 (Environmental Stress Crack Resistance), D-2565 (Ultraviolet). Meets UL94HB Horizontal Burn Test. Shall meet Arm Test for impact strength (@ minus 40°C) (.25 in. thickness). Shall meet color change criteria (QUV 500 hours per SAE 1960-89).
5. Vertical Wall panels - Shall be die-formed from a single sheet of12 gauge hot rolled, pickled and oiled flat steel. Vertical wall panels shall be an all-welded assembly, fabricated of 14 gauge, hot rolled, pickled and oiled flat steel, and 1/4” x 3” hot rolled, pickled and oiled

flat steel for back support or equal.


6. Steel Tubing – Components - Shall be fabricated of high carbon grade 1015 steel alloy. RS-20 galvanized steel tubing is 43% stronger (gauge for gauge) than Schedule 40 A-53 galvanized pipe. The comparison is based upon minimum yield strength and minimum tensile strength calculations.
7. Hardware

• All required hardware for assembly of the structure shall be included.

• All fasteners shall be 18-8 grade stainless steel. (300 series).

• All spring pins are stainless steel.

• All drive rivets are aluminum.

• All exposed fasteners shall be tamper-resistant. They shall only be

attached or removed using special tools not commercially available.

• A minimum of two tamper-resistant tools shall accompany each structure

for assembly and maintenance.
8. Installation Instructions - Explicit installation instructions shall be provided which will include a detailed top view and footing drawings plus written instructions to assure proper installation of the structure. Maintenance guidelines and inspection checklists shall also be provided.
9. Finishes
POWDER COATING

The polyester powder shall comply with the following ASTM Specifications:

B-117 (Salt-Spray Resistance Test), D-2794 (Impact Resistance Test),

D-1734 (Mandrel Flexibility Test), D-2247 (Humidity Resistance Test),

D-822 (Weatherability Test), D-3363 (Pencil Hardness Test),

D-3359-B (Crosshatch Adhesion Test), and D-2454 (Overbake Resistance

Test).

Prior to surface treatment, all metal shall be cleaned with a three-step



process, which includes a rust-inhibiting, iron phosphate wash. After

Powder Coating has been applied it shall be cured at temperatures

between 375 and 400 degree Fahrenheit.

• Powder Coating shall have an average thickness of 4 mils.

• Epoxy or hybrid paints are not acceptable.
10. Plastic Components -
COMPOUNDED, ROTAIONALLY-MOLDED PLASTIC.

• Shall be rotationally-molded from color-compounded, first quality,

linear low density, polyethylene.

- Dry-blended or molded-in resins are not acceptable.

• Shall be ultraviolet (UV) stabilized to UV-8 and have anti-static additives.

• Compounded, Rotationally-molded Plastic shall comply with ASTM Specifications:

D-1238 (Melt Index), D-1505 (Material Density), D-638 (Tensile Strength),

D-648 (Heat Distortion Temperature), D-790 (Flexural Modulus),

D-1693 (Environmetal Stress Crack Resistance), D-2565 (Ultraviolet).

SHEET PLASTIC PANELS

• Shall be fabricated from colored marine grade, 3/4” high density polyethylene and machined. All edges shall be free of burrs or sharp edges and points.

• Shall be ultraviolet (UV) stabilized.

• Meets FDA requirements.

• Shall comply with ASTM Specifications:

D-1238 (Melt Index), D-1505 (Material Density), D-638 (Tensile Strength),

D-648 (Heat Distortion Temperature), D-790 (Flexural Modulus),

D-1693 and D-2561 (Environmetal Stress Crack Resistance), D-2240 (Hardness),

D-1822 (Tensile Impact), D-746 (Brittleness), D-1525 (Softening Point).



11. SHOP DRAWINGS
Prior to fabrication the Contractor shall submit a set of shop drawings for approval by the Superintendent. Metal color samples as well as plastic color samples for the components shall be provided as part of the submission.

POURED IN PLACE RUBBER

  • This work includes furnishing and installing NO Fault Safety Surface or equal

  • The installer is responsible for all labor, materials, tools and equipment to perform the installation

  • The material shall be stable and slip resistant to comply with, meet or exceed all requirements to comply with ASTM, the ADA and the CPSC standards

  • The contractor is responsible for providing the sub base which shall be comprised of compacted stone

  • Surface must be installed after the playground is complete and the subsurface must be dry with no prospect of rain within the initial drying period, at temperatures recommended by the manufacturer

  • The surface will be protected by the Town from all traffic during the curing period of 48 to 72 hours

  • The contractor will be responsible for the protection during the installation process



Owners Responsibility: The Town of New Castle or their designee shall be responsible for the unloading of the delivered structures and temporary storage and site preparation. The Town or their designees shall also be responsible for the protection of the materials after delivery.

  • All bid submittals for the modular play structures MUST provide a separate detailed list of components proposed for each structure to assist in the evaluation of the number of play features associated with each structure.




  • All bid submittals should include detailed catalog photos or page #’s, model numbers and detailed specifications for all modular plays structures, swing sets and independent play features.




  • Certify that all structures / equipment are IPEMA certified and conforms to ASTM F1487.




  • The Non Collusion form provided must be completed, signed and returned with the bid packet.




  • A completed Divestment Form pursuant to N.Y. State Finance Law 165-a must be provided




  • The Bidder’s Reference form must be completed and returned with the bid packet.



Regarding Installation:



  • Installers must be certified by the manufacturer of the equipment they are installing.




  • Installers will be required to submit certificates of insurance and valid Workers Compensation coverage.




  • This is a prevailing wage project with certified payroll sheets required prior to payments being issued
