3. The offender may be disqualified from the practice of the profession in which he committed the
minor offence.

The term “irregularly available items” shall be understood to mean goods that by reason of their
nature or design, their origin or their condition, cannot be considered commonly available goods.
Section 437bis
1. A trader designated by Governmental Decree under section 437, who in the practice of his
profession or in the conduct of a business:
a. obtains property from a minor, or
b. obtains property from a person whom he knows or has reasonable cause to suspect has been
committed to a penal institution, a state institution for the care and protection of children or a
psychiatric hospital,
shall be liable to a term of detention not exceeding six months or a fine of the third category.
2. Any person acting on behalf of the trader defined in subsection (1), who commits an offence as
defined in subsections a and b of that section, shall be liable to the same punishment.
3. The offender may be disqualified from the practice of the profession in which he committed the
minor offence.
