If an item contains multiple embedded images and not all images are 
admitted into evidence as exhibits, the item will need to be removed, 
amended and resubmitted by the tendering party.

The legal representatives for the parties must be able to justify to the 
Court the purpose for which each document is included in the trial 
bundle.

The plaintiff is to ensure that items are complete, however new or 
replacement items may be added at a later date where necessary. In the 
initial upload, all documents should be identified as 'new' in the column 
'New or Replacement' on the excel spreadsheet. If a document needs to 
be resubmitted, then the entry in this column needs to be updated to 
'replaced,' so that the system can replace the existing item with the 
resubmitted item.

If there are numerous new or replacement items, the plaintiff should 
submit those new or replacement items on a USB, meeting the 
requirements referred to in pars 11 - 13 above.

If there are only a few new or replacement items, the plaintiff may email 
the associate to the case manager a request that they update the 
electronic trial bundle and index (attaching the relevant items to that 
email).

Once the trial has commenced, any requests to make changes to the trial 
bundle should be made orally to the judge in Court, or by email to the 
associate to the judge if Court is not in session.
Papers for the judge

The efficiency of an eTrial may be improved by the papers for the judge 
being provided on a USB, in which there are hyperlinks to all 
documents in the trial bundle that are referred to in the pleadings (or 
any affidavits ordered to stand as pleadings).

The set of standard directions for an eTrial of a civil action which are 
attached to this Practice Direction, at 1.2.5.1, include directions for the 
papers for the judge to be delivered to the associate to the case manager 
or trial judge on a USB and served on the defendant.

Unless directed otherwise, the parties must also file the papers for the 
judge electronically using the ECMS (O 33 r 14; O 67A r 3).

If a party subsequently files an amended pleading in accordance with O 
33 r 14(2) or (3), that party must submit to the associate to the case 
manager or trial judge a further USB in which there are hyperlinks to all 
documents in the trial bundle that are referred to in the amended 
pleadings.
