Section 436
1. Any person who, without being licensed to practise a profession for which a licence is required by
law, practises that profession without necessity, shall be liable to a fine of the second category.
2. Any person who is licensed to practise a profession for which a licence is required by law and
who, without necessity, exceeds the limits of his licence, shall be liable to a fine of the second
category.
3. If during the commission of the minor offence, one year has not yet expired since a previous
conviction of the offender for a similar offence became final, a term of detention not exceeding two
months or a fine of the third category may be imposed in the case set out in subsection (1), and a
term of detention not exceeding one month or a fine of the third category may be imposed in the
case set out in subsection (2).
