Limitations on the right to freedom of expression
Under international standards, restrictions on the right to freedom of expression must meet 
the conditions of so called “three-part test” which mandates that restrictions must be:

Provided for by law
; any law or regulation must be formulated with sufficient 
precision to enable individuals to regulate their conduct accordingly; 

In pursuit of a legitimate aim
, listed exhaustively as: respect of the rights or 
reputations of others; or the protection of national security or of public order (ordre 
public), or of public health or morals;

Necessary and proportionate in a democratic society
, i.e. if a less intrusive measure 
is capable of achieving the same purpose as a more restrictive one, the least 
restrictive measure must be applied.

Additionally, Article 20(2) of the ICCPR provides that any advocacy of national, racial or 
religious hatred that constitutes incitement to discrimination, hostility or violence must 
be prohibited by law. At the same time, inciting violence is more than just expressing 
views that people disapprove of or find offensive.

At the international level, the Office 
of the High Commissioner for Human Rights (OHCHR) within the United Nations (UN) 
has developed the Rabat Plan of Action which provides the closest definition of what 
constitutes incitement law under Article 20(2) ICCPR.
