Terms & Conditions – Heinz

This promotion is open to UK residents aged 15 years and under only. Proof of age may be required. You are not allowed to enter this competition if you, your parents/legal guardians or family members are employees of any British Sky Broadcasting Group company (“Sky”), of any HJ Heinz Foods UK Limited company, or any Nickelodeon UK company (“Nick UK”) or MTV Networks Europe, or any agencies involved with the competition, and all affiliates of such companies may not enter the Promotion.

Remember to get your parent’s or legal guardian’s permission before entering this competition. Because the Grand Prize is a holiday, please ask your parents or guardian to check your school holidays before entering to ensure you can accept the prize and avoid disappointment. Costs to enter competitions online may vary so don’t forget to ask the bill payer for their permission to enter this competition. Once they have given you permission, you can enter the competition by going to www.nick.co.uk/heinz and create a story about a tomato using the online tool. The promoter does not accept responsibility for network, computer or software failures of any kind, which may restrict or delay the sending or receipt of your mail. Proof of sending is not proof of receipt.

This promotion opens at 6.00am on 9 June 2014 and the closing date is 9.am on 28 July 2014.

You may enter as many times as you wish. Entries sent in through agents or third parties will be disqualified. Early, late, incomplete or otherwise ineligible entries will be disqualified.

Your entry must include your name, age, address (including postcode), your contact telephone number, email address and your story.

There will be one Grand Prize winner, three first runners-up and 300 secondary runnersup. Winners and runners up will be selected as follows:

Four entrants who in the opinion of the judges (made up of people at Heinz, Nickelodeon and The Promotions Factory (sitting as an independent judge)) have the most creative story which is suitable for TV will be put into a random draw.

One prize draw entry will be selected on the dates given below, providing entries are of sufficient quality, meaning stories will need to be suitable to be turned into a script and must fit with Regulatory Codes governing television advertising.

If entries are not of sufficient quality (in the opinion of the judges) or are not otherwise valid then the selection will roll to the following time period. The four people drawn will be notified by telephone within 4 days of being chosen.

The four people drawn will be put into a random draw. The first entry selected randomly from those four entrants will win the Grand Prize. The remaining three will get first runner-up prizes. The draw will take place on 28 July 2014 after 9.00am. Winners will be notified by telephone within 7 days of the closing date.

All entrants, excluding the shortlisted four entrants in Paragraph 6.1 above, will be put into a prize draw. The first 300 entries selected randomly from all of these entrants will win secondary runner-up prizes. The quality of the story will not affect this draw. The random draw will take place on 31 July 2014.

Grand Prize winner will receive the following prize: iPad Mini; your story made into a television advertisement for Heinz; and 7 nights in Tenerife for a family of four (two adults and two children aged 11 years or under at time of travel).

Prize includes:


  • return flights for two adults and two children to Tenerife (includes taxes and surcharges; departure airport will be dependent on direct availability from winner’s nearest available international airport, which may not be the nearest airport to the winner, children are those who are aged 15 or under at the time of the holiday);

  • return transfers to hotel from airport (may be shared with others);

  • 7 nights’ accommodation at the 5* Sansatori resort (two deluxe twin rooms with ensuite; full-board basis (some restaurants are adults-only and some are at a 25% discount rather than being included, or incur a charge for chef’s speciality dishes – please check before dining));

  • unlimited use of pools (spa pool incurs a charge);

  • daily activities (cocktail mixing, paddle tennis, wine tasting and tennis incur an extra charge); and

  • travel insurance (subject to insurer’s terms and conditions; pre-existing conditions may not be covered).

The prize does not include UK transfers, trips, taxes (other than as stated), service charges, or any other service or item not specifically described above.

Prize must be taken within 12 months of notification and may be taken during the October half term 2014, Easter holidays 2015 (excluding Easter weekend), May half term 2015 or October half term 2015. (Other dates are available for entrants who are below school age; excludes travel in July and August).

Travel is subject to availability and is at prize provider’s discretion.

Winner and guests are responsible for their passport and visa arrangements.

Each of the three first runners-up will receive the following prize: iPad Mini 16gb with WiFi; and their story will be turned into a television advertisement for Heinz.

Each secondary runner-up will receive a fridge magnet.

Copyright in all entries will be assigned to Sky.

There is no cash alternative to the prize and unless agreed otherwise in writing the prize is non-refundable and non-transferable.

The Promoter and/or Nick UK reserves the right to substitute the prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its control.

Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and/or Nick UK and each of their associated companies and agents exclude responsibility and all liabilities arising from any postponement, cancellation, delay or changes to the prize details beyond the Promoter’s and/or Nick UK’s control and for any act or default of any third party supplier.

The terms and conditions of any other third party supplier will also apply to the prize where applicable. If there is a conflict between third party terms and conditions and these terms and conditions, these shall take precedence.

The Promoter and/or Nick UK will not be liable for any prize(s) that do not reach the winners for reasons beyond the Promoter’s and/or Nick UK’s reasonable control.

The Promoter and/or Nick UK has the right to choose another winner (or winners) if:


  1. you do not comply with these rules or the Promoter and/or Nick UK has reasonable grounds for believing that you have broken a rule;

  2. the Promoter and/or Nick UK cannot contact you within a reasonable time after the closing date; or

  3. your parents/legal guardians do not (i) agree to these rules; (ii) want you to receive the prize; or (iii) give your consent as may be requested by the Promoter and/or Nick UK within a reasonable time.

The Promoter’s and/or Nick UK’s decision is final and binding in all respects on all entrants. No correspondence will be entered into. Entries that do not comply in full with these entry terms and conditions will be disqualified.

Details of the winners’ name and county will be available for one month after the close of this promotion by writing to the Promoter at the address below and stating the name and date of the promotion.

The name, county and photograph of the winners may be used by the Promoter and/or Nick UK and each of their associated companies for post-event publicity purposes. The winners agree to allow the Promoter and/or Nick UK to use their name and likeness for advertising and publicity purposes without additional remuneration.

In addition to the use specified above, the Promoter and/or Nick UK will use each winner’s, and each entrant’s, personal details for the purpose of administering this promotion.

The Promoter and/or Nick UK reserve the right to extend the closing date or terminate the competition and withhold the prize(s) where events beyond the Promoter’s and/or Nick UK’s reasonable control make such action necessary. The Promoter’s and/or Nick UK’s decision is final with respect to any aspect of the competition, including the choice of any winner of a prize. No correspondence will be entered into.

The Promoter may refuse or disqualify any entry (including winning entries) if the entrant concerned or anyone authorised by the entrant to deal with their entry, acts in a way towards the Promoter or Sky staff which the Promoter reasonably considers to be inappropriate, unlawful or offensive. If the winning entry is disqualified the Promoter reserves the right to award the prize to another entrant.

Entrants will be deemed to have accepted these terms and conditions and agreed to be bound by them when entering this Promotion.

This Promotion, and any dispute or claim (including non-contractual dispute or claim) arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Promotion.
