Short Bio of Philipp Hacker

Philipp Hacker, LL.M. (Yale), is a PhD student and research assistant at Humboldt University of Berlin, a member of its Graduate School "Unity and Difference in the European Legal Sphere" as well as a founder and organizer of the Humboldt Private Law Workshop (see http://grundmann.rewi.hu-berlin.de/events/HPLW.htm). His research interests include (behavioral) law and economics, contract law, company law, securities regulation, private law theory, law and philosophy as well as mathematical approaches to the legal arena.

As a high school student, Philipp won several awards at the German National Language Competition and at the German National Mathematics Competition as well as various prizes for his final exam. He studied law, philosophy and German literature at the universities of Munich and Salamanca. During his studies, he received various scholarships, inter alia from the German National Academic Foundation, the Bavarian Scholarship Association, and the Stiftung Maximilianeum (the most selective student scholarship in Germany). He worked as a research assistant for the University of Munich and for the Max-Planck-Institute for Innovation and Competition.p4261033

After graduating in law, he completed his compulsory legal traineeship (Referendariat) in Berlin, serving, inter alia, for the Court of Appeals for Berlin, the partner law firm of the German Embassy in Tel Aviv and the German Ministry of Economic Affairs in the department representing the Federal Republic of Germany before the Court of Justice of the European Union. The stage included an appearance before the Court in a leading migration law case.

In 2012, Philipp commenced his PhD thesis on the normative dimensions of behavioral law and economics under the supervision of Professor Stefan Grundmann at Humboldt University. A particular focus rests on the development of behaviorally informed alternatives to the disclosure paradigm in private law. In 2014, he graduated from the LL.M. program at Yale Law School, where he had founded and organized the reading group “The Debates on Rationality in Social and Legal Analyses” (jointly with Professor David Singh Grewal). He also collaborated closely with Professor Christine Jolls. For his graduate studies, Philipp received various scholarships, including by the European Recovery Program (ERP) of the German National Academic Foundation, by the German Academic Exchange Service, and by the state of Berlin.

Philipp is the co-author of "FairEconomy - Crises, Culture, Competition and the Role of Law" (with Wolfgang Fikentscher and Rupprecht Podszun, Springer, 2013), a book on the post-financial crisis global economic regime which was reviewed on multiple occasions and which inspired extended research programs in Europe and Japan. He has also published articles on criminal law and company law (in German). His working papers include Overcoming the Knowledge Problem - Bounded Rationality, Uncertainty, and Autonomy; En Route towards a More Behavioral Approach to Legislation and Adjudication? – A Critical Assessment of the Diverging Paths of the US and the EU; and Nudging and Autonomy. A Philosophical and Legal Critique. He has given lectures on behavioral law and economics as well as legal and private law theory at Yale Law School, at Humboldt University of Berlin, and at the European University Institute.

(Yale), ist Doktorand und wissenschaftlicher Mitarbeiter an der Humboldt-Universität zu Berlin, Kollegiat des Promotionskollegs "Einheit und Differenz im Europäischen Rechtsraum" sowie Gründer und Organisator des Humboldt Private Law Workshop (siehe http://grundmann.rewi.hu-berlin.de/events/HPLW.htm). Seine Forschungsinteressen umfassen Behavioral Law and Economics, Vertragsrecht, Gesellschaftsrecht, Kapitalmarktrecht, Privatrechtstheorie, Rechtsphilosophie sowie mathematische Methode im Recht.

Als Schüler wurde Philipp Bundessieger beim Bundeswettbewerb Fremdsprachen und gewann Preise beim Landes- und Bundeswettbewerb Mathematik. Er studierte Rechtswissenschaften, Philosophie und Germanistik an der LMU München und in Salamanca. Während seines Studiums erhielt er verschiedene Stipendien, unter anderem von der Studienstiftung des Deutschen Volkes, dem Max-Weber-Programm und der Stiftung Maximilianeum. Er arbeitete als wissenschaftlicher Mitarbeiter an der LMU München für Herrn Professor Fikentscher und am Max-Planck-Institut für Innovation und Wettbewerb für Herrn Professor Drexl.


Nach dem Studium der Rechtswissenschaften absolvierte er sein Referendariat in Berlin, während dessen er u.a. für den Vertrauensanwalt der Deutschen Botschaft in Tel Aviv tätig war sowie für das Referat im Bundeswirtschaftsministerium, das die Bundesrepublik Deutschland vor den europäischen Gerichten vertritt (EA5).


Im Jahr 2012 begann Philipp seine Doktorarbeit über die normativen Dimensionen von Behavioral Law and Economics unter der Leitung von Professor Stefan Grundmann an der Humboldt-Universität. Ein besonderer Schwerpunkt liegt auf der Entwicklung von verhaltensökonomisch informierten Alternativen zum Informationsmodell im Privatrecht. Sein LL.M.-Studium an der Yale Law School schloss er im Sommer 2014 ab. Dort hatte er u.a. die Reading Group “The Debates on Rationality in Social and Legal Analyses” gegründet und geleitet (gemeinsam mit Herrn Professor David Singh Grewal). Zudem arbeitete er dort eng mit Frau Professor Christine Jolls zusammen. Für seine Promotions- und LL.M.-Studien erhielt Philipp verschiedene Stipendien, unter anderem durch das European Recovery Program (ERP) der Studienstiftung des Deutschen Volkes, durch den DAAD und das Land Berlin.




Philipp ist Co-Autor von "FairEconomy - Crises, Culture, Competition and the Role of Law" (mit Wolfgang Fikentscher und Rupprecht Podszun, Springer, 2013), ein Buch über die globale Wirtschaftsordnung nach den Finanzkrisen. Das Werk wurde bereits mehrfach rezensiert und inspirierte Forschungsprogramme in Europa und Japan. Philipp hat ferner Artikel über Strafrecht und Gesellschaftsrecht veröffentlicht. Seine gegenwärtigen Working Paper umfassen Overcoming the Knowledge Problem – Bounded Rationality, Uncertainty, and Autonomy; En Route towards a More Behavioral Approach to Legislation and Adjudication? – A Critical Assessment of the Diverging Paths of the US and the EU; und Nudging and Autonomy. A Philosophical and Legal Critique. Er hat Vorträge über Behavioral Law and Economics, Privatrechtstheorie sowie Verbraucher- und Gesellschaftsrecht an der Yale Law School, der Humboldt-Universität zu Berlin und am European University Institute gehalten.
