Application of Manor Valley Taxi, Inc., a corporation A-00105983

of the Commonwealth of Pennsylvania, for amendment F. 2

to its common carrier certificate, which grants the Am-B

right, inter alia, to transport by motor vehicle, persons in paratransit service, between points in the borough of Manor, Westmoreland County, and points within four (4) miles of the limits thereof, which are north of the northerly right-of-way of Consolidated Rail Corporation, the boroughs of Irwin and North Irwin, and the township of North Huntingdon, Westmoreland County, and from points in said territory, to points within an airline distance of twenty (20) statute miles of the limits of the borough of Manor, and return: SO AS TO PERMIT the transportation of persons in paratransit service, between points in the boroughs of Adamsburg and Penn, and the township of Sewickley, all located in Westmoreland County, and from points in said territory, to points in Pennsylvania, and return.

O R D E R
BY THE COMMISSION:
This matter comes before the Commission on an application filed November 15, 2000. Public notice of the application was given in the Pennsylvania Bulletin of December 23, 2000. The above-mentioned carrier protested the application and the protest was withdrawn upon restrictive amendment.
The now unopposed application is certified to the Commission for its decision without oral hearing. The record consists of verified statements entered by the applicant and six (6) supporting parties.
DISCUSSION AND FINDINGS
Nancy Yurt, president of Manor Valley Taxi, Inc. (applicant or Manor Valley), is responsible for the day to day operations of applicant and is authorized to present the verified statement of applicant. Manor Valley conducts operations from facilities located at 9756 Broadway, North Huntingdon, Westmoreland County. Applicant has provided taxi service since 1984 and also provides paratransit service.
The North Huntingdon office employs dispatchers and service is provided six (6) days a week. Communications are maintained by Manor Valley’s own antenna which enables communications with its cabs and vans. All vehicles are equipped with two way radios. Applicant currently operates five sedans and four vans, two of which are wheelchair equipped. It also has a Chevrolet sedan as a back up vehicle. A comprehensive safety and maintenance program is in effect.
The balance sheet of the applicant for the year ending June 30, 1999 shows total assets of $39,937, total liabilities of $14,384, total shareholders’ equity of $25,553. The income statement for the year ended June 30, 1999 shows total revenues received of $286,102.15, total expenses paid of $224,842.26, excess of revenues received over expenses paid of $61,259.89 and a depreciation and vehicle lease expense of $(29,178.76) and an excess of revenues over expenses of $32,081.13.
Six (6) verified statements in support come from individuals who are all retired senior citizens requiring transportation services for grocery shopping, laundry, visiting nursing homes, malls, doctor visits and beauty shops. Transportation is required from the boroughs of Penn and Adamsburg and the township of Sewickley at least twice weekly, with requests for transportation to such points as Irwin, North Huntingdon, Greensburg and Jeannette.
A single carrier protested the application and that protest was withdrawn upon four restrictive amendments which are set forth in the right granted below.
After complete review of the record, we find:
1. Applicant currently holds authority to transport persons in paratransit service.
2. Applicant seeks to amend its authority and one protest was filed.
3. The protest was withdrawn upon restrictive amendments, as set forth below.
4. Applicant has the equipment, experience, ability and fitness necessary to render the service, as amended.
5. Six (6) parties support the application.
6. The evidence of record is sufficient to establish necessity for the service, as amended.
7. Approval of the application, as amended, is necessary for the accommodation and convenience of the public; THEREFORE,
IT IS ORDERED: That the right under certificate issued on March 26, 1987 as amended, is further amended to include the following right:
To transport, as a common carrier, persons in paratransit service, between points in the boroughs of Adamsburg and Penn, and the township of Sewickley, all located in Westmoreland County, and from points in said territory, to points in Pennsylvania, and return;
subject to the following conditions:
(1) That no right, power or privilege is granted to transport persons who, due to chronic or acute physical or mental conditions, required pre trip preparations such as assistance in being dressed or lifted, or medical monitoring, or the use of medical appliances or equipment, or a medical escort during transit;
(2) That no right, power or privilege is granted to provide service with vehicles having emergency vehicle registration plates or in vehicles operated by state certified emergency medical technicians;
(3) That no right, power or privilege is granted to transport non ambulatory persons to or from medical appointments from the boroughs of Adamsburg and Penn, and the township of Sewickley, except where service is provided pursuant to written agreements with federal, state or local agencies and payment is made by those agencies; and
(4) That carrier can only provide service to the curb at a person's residence and service cannot be provided if the person requires assistance in entering the person’s residence.
IT IS FURTHER ORDERED: That the applicant shall not engage in any transportation authorized by this order until the following is submitted to the Commission:
1. A tariff establishing just and reasonable rates.
IT IS FURTHER ORDERED: That the authority granted herein, to the extent that it duplicates authority now held by or subsequently granted to the applicant, shall not be construed as conferring more than one operating right.
IT IS FURTHER ORDERED: That in the event said applicant has not, on or before sixty (60) days from the date of the service of this order, complied with the requirements hereinbefore set forth, the application shall be dismissed without further proceedings.
