Section 139b 
1.  Any person who, with the intention of eavesdropping on or recording a conversation taking place 
elsewhere than in a dwelling or enclosed room or premises, by means of a technical device, 
surreptitiously:  
1°.  eavesdrops on that conversation without having been instructed to do so by a participant in that 
conversation; 
2°.  records that conversation without being a participant in it and without having been instructed to 
do so by such a participant; 
 
shall be liable to a term of imprisonment not exceeding three months or a fine of the third category.  
 
2.  Section 139a(2)(1°) and (3°) shall apply mutatis mutandis.
