JOHNSON COUNTY WEED AND PEST CONTROL DISTRICT

RIGHT-OF-WAY SPRAYING CONTRACT

AND

GENERAL BID REQUIREMENTS


The contractor shall furnish all equipment, labor, complete application records and supervision to perform, in a good and workmanlike manner, the application of pesticides on Wyoming Department of Transportation Interstate and Highway rights-of-way.
The District will provide the surfactant necessary. The Bidder may provide the herbicides, designated by the District, otherwise the District will supply all herbicides. If the Bidder exercises this option, so designate the price per gallon on the bid form, however, these prices will have no bearing on the bid and may or may not be used.
The contractor will have use of the District’s warehouse facilities as is deemed necessary and proper by the District Supervisor.


  1. Areas of treatment:

Interstate 25 - 263 lane miles (includes interchanges)

Interstate 90 - 205 lane miles (includes interchanges)

U.S. 16 West - 96 lane miles

U.S. 16 East - 36 lane miles

Wyoming 196 South - 100 lane miles

WY 387 - 22 lane miles

WY 190 - 19 lane miles

WY 191 - 23 lane miles

WY 192 - 72 lane miles

US 87 & WY 93 - 7 lane miles

Interstate 25 Service Road - 25 lane miles

A TOTAL of 868 lane miles


Copies of previous years treatments are available for inspection at the District office during regular business hours.


  1. The contractor shall in performance of the contract:

A. Provide a certified commercial applicator that shall perform

and/or supervise the work;


B. Comply with County, State and Federal laws, rules and

regulations; in particular Wyoming Department of Transportation

requirements;
C. Comply with all Federal labels when mixing and applying

pesticides;


D. Provide liability insurance and other insurance coverage

as the contractor deems proper and necessary to protect the

District from any expense in the case of any legal action.

E. Provide application equipment that is properly calibrated to

deliver accurate application rates of the herbicides as set forth by

the District Supervisor. The Contractor shall provide detailed



calibration procedures for each implement to be used prior to

performance of the contract.



F. Treat weeds designated by the District throughout the entire

right-of-way, i.e. from fence line to fence line. See Appendix A


  1. Provide a written list of the knapweed species (3) and leafy

spurge that appear to be isolated or outbreak infestations outside of

the DOT’s fence line.




  1. Notify the District of any new insipient invading weed species.




  1. Adhere to all applicable OSHA standards to protect workers from safety and

Health hazards and correct violations the District discovers.




  1. Provide proof of Hazard Communication Program.



  1. Any road section under construction during the treatment season may or may not be treated, upon mutual

Agreement between the applicator and the District. As such, the total lane miles under construction that are not treated shall be deducted from the total billable miles contained herein.

  1. The contractor agrees to indemnify and hold harmless Johnson County Weed and Pest Control and Pest Control District and its agents and employees from and against all claims, damage, losses, expenses and injuries arising out of any negligent act or omission by the contractor, its agents or employees, in the performance of the contract and/or any addenda made a part thereof.

  2. Spraying of all road sections outlined in the Areas of Treatment shall be performed (as permitted by weather conditions) between June 20th and August 10th, except for US 16 West. Treatment dates for this maintenance section shall be between August 1st and September first, and upon approval of the District Supervisor. The contractor is further required to use only backpack spray equipment or a handgun on a truck mounted sprayer with two people for this maintenance section.

  3. The contractor shall perform all work in a good and workman like manner.

  4. The District Supervisor shall perform spot inspections from time to time of equipment for proper running condition (i.e. – no leaks, etc.) and calibration, and of work being done by the contractor.

  5. Payment to contractor – upon completion of the contract – three fourths of the total bid price shall be paid to the contractor for all road sections, except US 16 West. The contractor or its agent and the District Supervisor shall do a performance test in one (1), but no later than, three (3) weeks following completion for final job quality approval. Upon completion, payment for US 16 West shall be in the same manner as described above.

If the District is not completely satisfied, within reasonable limits, the contractor shall treat areas skipped to the Supervisor’s satisfaction. Final payment for all road sections shall be dated on or about September 12th of the contract year to allow for weed mortality and insure final job quality approval, unless further application is necessary.

  1. Contract period- this contract shall run continuously from June 1, 2012-October 1, 2012. The District may temporarily suspend or terminate this contract during the contract period for:

  1. Unsatisfactory contractor performance of the duties listed,

  2. Poor climatic conditions that may result in poor control,

  3. Lack of funding.

The District, at its discretion, may enter into an agreement with the contractor to extend this contract for the same contract period the following year provided: the contractor performed the duties of the contract to the satisfaction of the District and the contractor agrees to extend the same cost of said services during the 2013 treatment season. The contract may be again extended for the 2014 season provided the aforementioned conditions are met. Any contract extensions shall be so noted as addendums to this contract.
