Construction (Head Protection) 
Regulations 1989
17.9.1 Application
These Regulations apply to ‘building operations’ and 
‘works of engineering construction’ as defi ned originally 
by the Factories Act 1961.
17.9.2 Provision and maintenance
Every employer must provide suitable head protection 
for each employee and shall maintain it and replace it 
whenever necessary. A similar duty is placed on self-
employed people. The employer must make an assess-
ment and review it as necessary, to determine whether 
the head protection is suitable. Accommodation must be 
provided for head protection when it is not in use.
17.9.3
Ensuring that head protection is worn – 
Regulation 4
Every employer shall ensure, so far as is reasonably prac-
ticable, that each employee (and any other person over 
whom they have control) at work wears suitable head 
protection, unless there is no foreseeable risk of injury to 
their head other than through falling.
