A. Folino Construction for the paving of 16th St. from Acheson to Robbins, 18th St. Awarded

from Acheson to Moore, and the apron on Cochran Avenue, contingent upon the

results of investigation of the company – ayes 5, nays 0.


The following bids were received for the 18th Street storm sewer improvements; St. Sewer

Tito Pollice Company $39,840.00

Holbein Inc. $38,620.00

Morgan Excavating $21,611.00


Motion was made by W. Campbell, seconded by T. Newton, to award the contract for Morgan Ex

storm sewer improvements on 18th Street to Morgan Excavating , contingent on Awarded

investigation results.
Public Participation: Discussion took place with Dan Lambing 1821 Acheson Ave. Property

regarding conditions at 1819 Acheson. He was advised that a citation was issued and Cond.

the owner has 10 days to act.
Discussion took place with Jennifer Rumbaugh, 1410 Center Ave., regarding neighbors Fires

having fires in their yard and enforcement and possible changes in the burning ordinance.


Discussion took place with Melissa Back, 1211 Cochran Ave., regarding the grass at Grass

1214 Robbins, junk cars in the area of the park on 13th Street, and stray cats in the area. Junk


Property & Ordinance: The dispute over a fence that would block a Borough right of Fence

Dispute way in the area of Cedar Avenue and Peach Street was discussed. The alley was moved by installation of a retaining wall and is now on the property of David Speer. Speer has been advised not to put up the fence until the problem is solved. A. Urti is to write an opinion on the subject.
Grass W. Campbell reported that Borough catch basins are being plugged by grass clippings that

Ross S. Ross gave his report of recent activities. There is a sewer problem in a garage on Center

Report Avenue. Fire damage at the R Bar has yet to be repaired and architect plans are required to proceed.


Pay Bills Finance: Motion to pay the bills presented was made by E. Barclay, seconded by T. Newton – ayes 5, nays 0. (See voucher register for June, 2013).
Treas Treasurer’s Report: E. Stitt reported the following May 31, 2013 balances in the Borough’s accounts: General Fund, $214,639.60; Garbage & Refuse, $19,314.37; Liquid Fuels, $35.925.05; and Sewer Recovery, $168,925.05.
Collected Garbage Fees totaling $7,222.84, including $2,216.00 in delinquents, were collected in May, 2013. Sewer Recovery Fee collections for May totaled $15,585.71, including $1,717.31 in delinquents. Fire Protection Fee collections totaled $16,508.35. Progress is being made in updating the customer lists and collecting delinquent garbage fees.
Fire Fee The Fire Department’s requirements under the new Fire Protection Services Fee ordinance were explained by A. Urti.
VFD In response to a request by the North Apollo Volunteer Fire Department, motion was

E.O.P. The Borough’s Emergency Operations Plan needs to be updated for the Borough to be eligible for federal funds in an emergency. Mainly, contacts need to be updated.
Police Mayor’s Report: T. Newtonm read the report of Police activities. There were 45 total calls, 27 incidents reported,3 criminal arrests, 1 traffic and 3 non-traffic citations.
Exec. Motion to go into executive session to discuss a personnel matter was made by T. Newton, seconded by W. Campbell – ayes 5, nays 0.

A dye test was done at the James Crawford property at 1326 Oakwood Avenue in Dye Test

Preparation for a possible water line. Motion was made by T. Newton, seconded by Oakwood

W. Campbell, to waive the fee to the owner for the dye test – ayes 5, nays 0.

July 1, 2013
The regular meeting of North Apollo Borough Council was called to order at 7:00 PM in

the conference room of the municipal building by President E. Burns, who led the Pledge

of Allegiance. Roll Call of Members: The following members were present; E. Burns, E.

Hall, T. Newton, and W. Campbell. Absent was E. Barclay. Also present were Sec’y E.

Stitt, Solicitor A. Urti, Equipment Operator B. Beck, Code Enforcement Officer S. Ross.

Mayor E. Artman was not present.


Public Participation: As there were a number of visitors wishing to comment on the Library

Library Tax, E. Burns advised that a 5 minute limit per speaker would be in force. Tax


T. Newton read a letter explaining his opinion regarding the Library Tax. He stated that T. Newton

it was his belief that the residents should have a vote as to whether or not to continue Letter

with the Tax
Marlene Beck, 1403 Center Avenue, expressed support for the library, stating that the M. Beck

matter shouldn’t be the Library vs. the Fire Department. She also explained some of the

services available from the Library, including those that don’t require membership.
Ray Rusz, 2132 Stoops Court, stated that the Library should stay.
Vivian Shaeffer, 1506 Redwood Avenue, gave the opinion that the Library should be V.

paid according to the number of residents rather than the value of the houses in town. Shaeffer


Donald Acker, 1308 Cedar Avenue, advised that the people need to make their voices D. Acker

heard as to whether or not they wish to support the Apollo Library through the tax.


E. Burns noted that no action can be taken by Council until the signatures can be Petition

obtained on the petition to place the Library Tax referendum on the November ballot.

St. Drain The problem of storm drainage from Kiskiminetas causing problems on the property at the corner of 16th Street and Birch Avenue was discussed. S. Ross suggested getting both municipal engineers to work on a solution.
Ordinance Discussion took place with visitor Donald Acker regarding Kiskiminetas Township’s enforcement of Borough ordinances and the dispute between Acker and David Speer over a fence that Speer wants to install.
Minutes Minutes of the meeting of June 3, 2013 were accepted by motion of T. Newton, seconded by E. Hall – ayes 4, nays 0.
Code Code Enforcement: Sam Ross reported that 40 zoning permits have been issued this year,

Report and 36 complaints on delinquent garbage accounts are ready to be filed with the Magistrate.


St. Swr. Streets: A problem was reported with a sanitary sewer going into a storm sewer at 1724 Wilson Avenue.
Tk Bed A hinge broke on the bed of the ’01 truck, and the bed might need to be replaced. An aluminum bed is available for $6,900.00. The old bed will be checked to find out if it is fixable.
O Turn Three quotes were obtained for a zero turn mower, with the lowest price of $4,733.00

Mower received from Minich’s Sales & Service. No action taken until it is determined what the cost will be to fix the ’01 truck.


Grass Motion was made by W. Campbell, seconded by T. Newton, to authorize the Solicitor to

Ord. an ordinance prohibiting grass clippings from being left in the streets – ayes 4, nays 0.


Weedkill W. Campbell advised that some weed killer has been ordered to be tested.
Water W. Campbell reported that a new water line is being installed on Hickory Nut Road and

Line suggested that the Borough look into some additional paving along Hickory Nut.

Lien Solicitor: A. Urti advised that a lien is to be filed on 1214 Robbins Avenue for the costs of

the Borough mowing the property.


Oakwood The sanitary sewer in the Oakwood Avenue area goes into Kiskiminetas Township. A

Sewer proposed agreement with Kiski to be reviewed would call for no user fee but maintenance costs would be shared based on the number of units we have going into the sewer.


Waive Due to this being the first year of the Fire Protection Services Fee and there are still some

billing problems to be worked out, motion was made by T. Newton, seconded by W. Late Fee

Campbell, to waive the late fee for this year’s Fire Protection Services Fee – ayes 4,

Treasurer’s Report: E. Stitt reported the following June 30 balances in the Borough’s Balances

Accounts: General Fund, $249,008.44, Garbage & Refuse, $13,845.52; Liquid Fuels,

$34,536.79; and Sewer Recovery, $177,755.54.
Garbage Fee collections totaled $2,947.50, including $2,483.20 in delinquent accounts. Collection

Sewer Recovery Fee collections totaled $12,589.39, including $3,271.31 in delinquents.

Fire Protection Services Fee collections totaled $9,675.00.

Hearing North Apollo Borough Council met at 6:30 PM in the conference room of the municipal

Cond Use building for the purpose of conducting a public hearing regarding the request of Richard

Rhoades for a Conditional Use for the property at 2112 River Road which would allow light assembly work on that property. Members present were E. Barclay, E. Burns, E. Hall, W. Campbell, and T. Newton. Also present were Sec’y E. Stitt, Code Enforcement Officer S. Ross and Solicitor A. Urti. Transcript of the hearing was taken by Court Reporter Domenica Vogel.
Granted Motion was made by T. Newton, seconded by W. Campbell, to grant a Conditional Use to Richard Rhoades which would allow him to conduct light assembly work at 2112 River Road – ayes 5, nays 0.

The regular meeting of North Apollo Borough Council was called to order at 7:00 PM in the conference room of the municipal building by President E. Burns, who led the Pledge of Allegiance. Roll Call of Members: The following members were present; E. Barclay, E. Burns, W. Campbell, E. Hall and T. Newton. Also present were Sec’y E. Stitt, Solicitor A. Urti, Code Enforcement Officer S. Ross, B. Bothell from Senate Engineering, and Equipment Operator B. Beck.
Baker Public Participation: Visitor Eric Baker, 611 16th Street, complained of storm water

Flooding draining across Hickory Nut Road and flooding his property and asked that a curb be placed to redirect the water. B. Bothell was asked to check into the matter.


R. Dixon Rich Dixon, from the Roaring Run Watershed Association, asked Council to consider zoning changes for the Pegtown area that would allow businesses to develop in that area. Discussion also took place regarding the parking lot installed by the Watershed Association in Pegtown. It was paved before the paving plans were approved by Council.
Kiski Discussion took place with Lee Layton regarding possible remedies for the problem of

Drainage storm water coming from a property in Kiski Township and flooding a property at 1503 Birch Avenue


D. Crofutt Discussion took place with Darrell Crofutt, 1816 Hickory Nut Road, regarding who owns the paper streets that have not been opened.
Sher. Sale Property & Ordinance: Discussion took place regarding properties that were up for Sheriff Sale and on which the Borough has liens and claims.

Public Safety: T. Newton read the Police activities report in E. Artman’s absence. Police

Engineer: B. Bothell reported that the 18th Street storm sewer project is mostly complete 18th St

except for the trench drain. The paving portion of the project was eliminated due to the St. Swr

upcoming paving project, thus saving money on the final bill.
A change order for $1,080.00 in curbing for 18th Street was recommended for the paving Ch Order

project. Motion was made by W. Campbell, seconded by T. Newton, to approve Change

Order #1 for the paving project, allowing for $1,080.00 in additional curbing for 18th

Street – ayes 5, nays 0.


Paving has been delayed due to frequent rains. The Acheson Avenue emergency storm Paving

sewer project is completed. It was determined that there is no public access from Locust Locust

Avenue to Kiskiminetas Township.
The Hickory Nut Road water line was discussed. Water

Discussion took place regarding the proposal from Kiskiminetas Township to give all Police

the Police fine money to them rather than increase the fee paid to the township for Police Proposal

service.
After discussion the sewer maintenance agreement with Kiskiminetas Township for 14 Sewer

It was noted that the deadline to place the referendum for the Library Tax is September Library

5. E. Barclay moved to schedule a special meeting to act on the petition to place the Tax

referendum on the ballot but the motion died for lack of a second.
Finance: Motion was made by E. Barclay, seconded by T. Newton, to pay the bills Pay Bills

presented - ayes 5, nays 0. (See Voucher Register for August, 2013).


Motion was made by E. Barclay, seconded by T. Newton, to eliminate the Cintas Uniforms

Uniform service for the street workers and instead purchase uniforms for an estimated

$385.00. During discussion it was determined that such a change should be the subject

of negotiation. Therefore, the motion was withdrawn by E. Barclay and T. Newton

pending an executive session. E. Burns then tabled the subject for the month.

Balances Treasurer’s Report: E. Stitt reported the following July 31, 2013 balances in the Borough’s accounts: General Fund, $240,329.11; Garbage & Refuse, $16,326.49; Liquid Fuels, $33,148.39; Sewer Recovery, $168,395.40.


Collected Garbage Fee collections for July totaled $7,656.16, including $661.28 in delinquent accounts. Sewer Recovery Fee collections totaled $2,194.14, including $632.19 in delinquents. Fire Protection Services Fee collections totaled $11,610.00.

Special North Apollo Borough Council met in special session at 6:30 PM in the conference room

Session of the municipal building with the Pledge of Allegiance led by President E. Burns. The meeting was called for the purpose of taking necessary action regarding the Borough’s Workers Compensation Insurance and for consideration of any other business duly brought before Council. Members present were E. Burns, E. Hall, and T. Newton. Absent were E. Barclay and W. Campbell. Also present were Sec’y E. Stitt and Insurance Agent Connie Jerich.


Jerich Connie Jerich explained that the Borough’s Workers Compensation Insurance had to be

Explains changed because coverage for the fire department is no longer available from most companies. Three proposals were received. The least expensive was a combination of EMC Insurance for the Borough’s coverage and the State Workers Insurance Fund for the fire department. The total premium would be $16,426.00. That is about $5,000.00 more than the previous policy due to recent claims history. An advantage to this plan is that the fire department and Borough would be treated separately and claims of one outfit would not affect the premium of the other. Motion was made by T. Newton, seconded by E. Hall, to accept the proposal that would divide the coverage between EMC Insurance and the State Workers Insurance Fund fr a total of $16,426.00 – ayes 3, nays 0.


Survey A proposal was received from Senate Engineering to survey a disputed property on Cedar Avenue for $2,600.00. Motion was made by T. Newton, seconded by E. Hall, to accept the proposal for the survey – ayes 3, nays 0.

The regular meeting of North Apollo Borough Council was called to order at 7:00 PM

in the social hall of the North Apollo Volunteer Fire Department by President E. Burns,

who led the Pledge of Allegiance. The meeting was moved from its usual location in

the conference room of the municipal building due to a large expected turnout of

residents wishing to discuss problems resulting from the August 28 rainstorm. Roll

call of members: The following members were present; E. Barclay, E. Burns, W.

Campbell, E. Hall, and T. Newton. Also present were Solicitor A. Urti, Sec’y E.

Stitt, and B. Bothell from Senate Engineering Co.


Public Participation: The following residents wished to discuss problems relating to Flooding

the flooding during the August 28 rainstorm. Problems

Eric Baker 601 16th Street, repeated basement flooding. A possible curb across Hickory E. Baker

Nut Road was discussed.

Kevin Gibbons, 1823 Wilson Avenue, a backup into the house through the sewer K. Gibbons

John Simon 1718 Wilson Avenue, a manhole vault blown out in field behind his home J. Simon

Brenda Brinker, 1823 Acheson Avenue, Delaware Alley is higher than her property B. Brinker

Mark Lees, 1419 Wemple Avenue, questioned the status of a neighboring property that M. Lees

Parks, Etc. sewer drains, and the Fire Tax.
