Information for the mediation
15. The mediator may direct that the parties provide information to assist 
them as mediator to efficiently and productively manage the mediation.
This could include providing: 
•
Copies of key documents. 
•
Copies of without prejudice correspondence. 
•
Copies of experts' reports. 
•
A chronology of relevant events. 
•
A mediation briefing note. 
A direction to provide these documents will be by letter from the 
associate to the mediator. At the conclusion of the mediation, any 
documents provided will be kept confidential or be returned to the 
parties.
15A. The usual order made by the Court is that the solicitors for each party 
provide to the mediator (by email to the associate to the mediator) a 
copy of the memorandum of costs provided to their client on a 
confidential basis (see par 11(d) and (da)). The mediator may make a 
further direction that the parties provide, on a confidential basis, a copy 
of the memorandum of costs to the other party or parties. If making

such a direction, the mediator will also direct that at the conclusion of 
the mediation the memorandum provided will be kept confidential or be 
returned to the party who provided it.
15B. The purpose of open disclosure as to costs between the parties and the 
mediator is to allow the mediator to openly comment on the value, 
importance and complexity of the subject matter and the financial 
position of each party. Transparency as to costs may assist the parties to 
put the cost of proceedings into perspective and encourage them to 
settle the dispute.
