STATE OF NPAS IN INDIAN ECONOMY 
PRIOR TO THE ENACTMENT OF IBC
– The 
concept of NPAs was first introduced by the Narsimham 
Committee (1991) on “Financial Sector Reforms” [6]. 
The Financial Stability Report of June, 2016 (released 
by RBI) confirms the fact that not all is well in the 
health of Indian banks. Following Chart 1, shows that 
the behaviour of NPAs of banks in India.

The chart shows improvements from the year 2002 
to about 2009. The NPA situation started deteriorating 
thereafter, to the extent that by March 2016 it seemed 
that all the growth made till then had evaporated. 
PSBs had accounted for 78 per cent of the NPAs [7]. 
Creditors had weak rights and hence the recovery rate 
(hardly 20% of the value of the debt) was very low. The 
Indian credit market was malfunctioning at that time 
and IBC was seen as a revolutionary step to transform 
credit market in India.
Before the codification of IBC, insolvency cases 
were dealt with by High Courts, District Courts,

Company Law Board, Debt Recovery Tribunals (DRTs) 
and Board for Industrial and Financial Reconstruction 
(BIFR) which gave rise to complexity, undue delay 
in the process and over lapping of decisions. There 
was a lack of clarity over jurisdictions. The following 
Table 1 shows the NPAs of the Scheduled Commercial 
Banks (SCBs) recovered through different forums (Lok 
Adalats, DRTs, SARFAESI Act) [8].
