OPENING
Commissioner Gartner called the meeting of the Dawson County Zoning and Planning Commission to order at 6:30 PM on Thursday, August 1st at the Dawson County Courthouse. He introduced the new county planner, Dianna Broadie.
REVIEW OF HIGHLAND PARK ZONING REGULATIONS
8.9-10 Add the word, be, “shall be submitted” Change Zoning Enforcement Agent to Zoning Administrative Agent. Remove the subcategory 1, as there is no 2. Change the word developments to improvements
Section 9.1, See Section 6 and 6.1 for home occupation. Dianna suggested having administrative conditional use permits to streamline the process for the public. Add to subsection 3. Grant conditional use permits. (other than administrative).
Go back to Section 6 and reword so that Home Occupations could be reviewed and Add an administrative uses section.
Section 5. Additions Levy up to 1 mill on the taxable “real” property within the Planning and Zoning Distirct “for administrative costs”

Add a section for pre-approval and the right for the zoning administrator to waive portions of application that would not be necessary.

Change the fee scale to read
$5.00 for construction valuation up to $10,000
$25 for construction valuation from $10,001 to $50,000
$50 for construction valuation over $50,000
(Possibly add this to a County Fee Schedule and change to read subject to Commissioner Fee Schedule)
9.4-4 Change building permit to Zoning Compliance Permit “will be issued” by the Zoning “Administrative” Agent
9.4-5 Change building permit to Zoning Compliance Permit.
9.5-5 Change Zoning Enforcement Agent to West Glendive Public Works Department.
Note-Have the Public Works director review the Trenching Section of the document.
9.6-1 Remove the – after variance. Period after the phrase classification district. Fix the funky font change.
9.6-2 Capitalize Use. Remove the – on the sentence only if it is found. Change the phrase “neighborhood district to be detrimental or injurious” to “neighborhood district or to be detrimental or injurious”
9.6-3 Section 4 Change case to cash.
9.6-4 Change Zoning Enforcement Agent to Zoning Administrative Agent. Change the dollar amount to “as set by the Dawson County Commissioner Fee Schedule”
Section 2 a space between “ for and a” conditional use.
Note: numbering is off and needs to fixed
9.6-6 Part 1. Change Zoning Enforcement Agent to Zoning Administrative Agent. Changing Soning to Zoning.
Part 2, Change freeholder to resident. Include a section that states the first appeal would go to the Dawson County Board of Adjustments.
9.7 Change building permit to Zoning Compliance Permit
9.7-3 add the word use “at the time of use classification” Remove the s on classifications. Possibly reword this whole sentence.
9.8-1 Remove the s on purposes.
9.8-4 Change the (26.00) to (25.00) Change Zoning Enforcement Agent to Zoning Administrative Agent. Remove the word structurally. Made use used. “used in violation”
9.9-2 Change Zoning Enforcement Agent to Zoning Administrative Agent. Change the dollar amount to read as set by the Dawson County Board of Commissioners Fee Schedule.
9.9-4 Dianna will check on the legal requirements.
9.9-4 Shirley questioned if these notifications would need to be sent certified or if this could be struck. It could be extremely costly to send notices to everyone in the subdivision certified mail if it affected everyone. There was discussion about using Signage. There was also some question if term “all property owners affected by the change” could be open to interpretation and if it could be clarified more.
9.9-5 On the last sentence change “elective except” to “effective except”.
9.9-6 The beginning should read….”An applicant”, any resident in the Planning and Zoning District. Check on whether this decision would be appealed to the Board of Adjustments or directly to the District Court. Change saving to serving.
10.3 Remove the words structurally. And change increase to increases.
10.5 There was discussion about the term assessed valuation and whether that is the value the commission intended to be there. There was some discussion about changing it to actual value or ½ of the replacement costs. No decision was reached, but rather everyone agreed to think about this.
The meeting adjourned at 9:00 p.m.
