Section 161quinquies 
 Any person who, through negligence, causes human beings, animals, plants or property to be 
exposed to ionising radiation, or causes human beings, animals, plants, property, soil, water or air to 
be contaminated with radioactive materials, shall be liable to:  
1°.  a term of imprisonment not exceeding one year or a fine of the fourth category, if such act is 
likely to endanger public health or the life of another person;  
2°.  a term of imprisonment not exceeding two years or a fine of the fourth category, if such act is

likely to endanger the life of another person and the offence results in the death of a person.
