Section 53 
1. In the case of serious offences committed by means of a printing press, the publisher shall not be 
prosecuted in his capacity as publisher if his name and address appear on the printed matter and 
the identity of the offender is known or if, upon first notice, after institution of a preliminary inquiry, 
the publisher has disclosed the identity of the offender. 
2.  This provision shall not apply if, at the time of publication of the printed matter, the offender could 
not be prosecuted or was resident or established outside the Kingdom in Europe. 
Section 54

Section 54a 
An intermediary which provides a telecommunication service that consists of the transfer or storage of 
data from a third party, shall not be prosecuted in its capacity as intermediary telecommunication 
provider if it complies with an order from the public prosecutor to take all measures that may be 
reasonably required of it in order to disable this data, which order shall be issued by the public 
prosecutor after he has applied for and received a written authorisation from the examining magistrate.
