Costs - failure to cooperate 
35. Each party's costs of and incidental to a mediation are the party's costs in 
the cause. A party to a mediation may, however, apply for the costs of a 
mediation if they have been incurred unnecessarily by the conduct of 
another party - see O 4A r 8(4)(c). Such an application should be made 
to the case manager. The mediator, if a judicial officer, will not usually 
make any costs order in a mediation. 
36. The mediator may report to the Court on any failure by a party to 
cooperate in a mediation - see O 4A r 8(5)(b) and (6). 
Mediation of appeals 
37. The Court of Appeal encourages all parties to an appeal to consider 
mediation as a way of achieving a final resolution of their dispute.
Mediation of appeals is generally conducted on the same basis as 
mediations of civil cases except that the time for the mediation 
conference is normally limited to 1.5 - 2 hours unless the parties agree to 
extend the time. Any party who is interested in arranging a mediation of 
an appeal should contact the Associate to the Court of Appeal Registrar.
