Taking Affidavits

Introduction 
 
1. 
All affidavits for use in the Court must be taken in conformity with the 
Oaths, Affirmations and Statutory Declarations Act 2005
(OASDA).

Of particular note are the provisions of s 9 as to the manner of taking 
affidavits, and of s 15 prohibiting the use of rubber stamps for 
signatures. 
Affidavits sworn in Western Australia 
 
3. 
Section 9(5)(a)(ii) of the OASDA requires an authorised witness to 
imprint or clearly write his or her name and qualification as an 
authorised witness at or near the statement on the affidavit that it has 
been sworn or affirmed by the person making it in the presence of an 
authorised witness. 
4. 
If the witness is an 'experienced legal practitioner' as defined by the 
OASDA, the following form of endorsement will satisfy s 9(5)(a)(ii) of 
the OASDA and should be used by practitioners:
