3. 17-0707 Discussion and Possible Action to Approve Subdivision and Authorize Mayor and City Clerk to Sign Plat to Vacate Fairway Condominiums and Establish Fairway Town Homes Lying Within Lot 1-1-“A” of Coyles Scenic Heights in the NE Quarter of Section 29, Township 29 North, Range 2 West of the 4^th P.M., City of East Dubuque, Jo Daviess County, Illinois / Mayor Welp, City Manager Barklow, Alderman Arling

  City Manager Barklow: The Zoning Board held a public hearing and has moved to recommend the current zoning be changed to reflect current usage. The zoning will be changed from recreation to residential. This was a request from the property owner.

4. 17-0708 Discussion and Possible Action to Pass Ordinance for Zoning Text Amendment in the City of East Dubuque, Jo Daviess County, Illinois / Mayor Welp, City Manager Barklow

  City Manager Barklow: This ordinance is in relation to the previous agenda item concerning the rezoning. The original date of the meeting was July 17^th 2017 and the text therefore needs to be changed to reflect the most recent meeting on August 2, 2017. Recommends the Council to approve.

  Motion made by Alderman Arling to Action to Pass Ordinance for Zoning Text Amendment in the City of East Dubuque, Jo Daviess County, Illinois, with changes to the text pertaining to the date of the meeting to August 2, 2017, seconded by Alderman Digman; four ayes, motion carries. 5. 17-0803 Discussion and Possible Action to Pass A Resolution Authorizing Execution for the Sale of Surplus Municipal Property in the City of East Dubuque, Jo Daviess County, Illinois / Mayor Welp, City Manager Barklow ROLL CALL

  City Manager Barklow: This resolution pertains to the old street sweeper that has been replaced. Recommends the Council approve.

6. 17-0804 Discussion and Possible Action to Pass An Ordinance Authorizing Execution for the Sale of Surplus Municipal Property in the City of East Dubuque, Jo Daviess County / Mayor Welp, City Manager Barklow ROLL CALL

  City Manager Barklow: This ordinance pertains to the previous resolution of declaration of surplus municipal property of the street sweeper. Recommends the Council to approve.

  Motion made by Alderman Degenhardt to Pass An Ordinance Authorizing Execution for the Sale of Surplus Municipal Property in the City of East Dubuque, Jo Daviess County, seconded by alderman Digman; four ayes, motion carries. 7. 17-0805 Discussion and Possible Action to Pass An Amendment to Ordinance Regulating Alcoholic Beverages Within the City of East Dubuque, Jo Daviess County / Mayor Welp, City Manager Barklow ROLL CALL

  City Manager Barklow: The Ordinance committee met and would like to see the language changed regarding the ability of persons between the age of 18 and 20 working in an establishment that serves or sells alcohol being a relation to the owner of the facility only.

  Discussion:
  
  • 
    Alderman Arling: Concerned with how this language will affect the right to work for those not only the bars but at the gas stations and Van’s as well. There are lots of people that carry out beer after school and over the summer at Van’s that this could affect. What is the reason why the committee wants to change this? Mayor Welp: There was a mishap with a bartender that was 19 years old who was working downtown at one of the bars and she went into another bar after allowed hours. Alderman Arling: There are laws set into place that state no person under the age of 21 years is allowed to enter the bars after a certain time, changing an ordinance and eliminating someone’s right to work within that age group is not the answer. This mishap falls on the bar owner and their staff. Would like to see this tabled until further discussion on the language being changed can be arranged. Alderman Robey agrees with this.

8. 17-0806 Discussion and Possible Action to Pass An Amendment to Ordinance Regulating Traffic Schedules Within the City of East Dubuque, Jo Daviess County / Mayor Welp, City Manager Barklow ROLL CALL

  City Manager Barklow: The original enactment was to change municipal streets from 20MPH to 25MPH.
  
• 
  Alderman Arling: Spoke with Alderman Vanostrand about this, and would like to see this tabled until certain streets can be identified to increase the speed limit as some of them should essentially be lower than 25MPH.

9. 17-0807 Discussion and Possible Action to Approve Video Gaming License for Rosy’s Inc. at 1705 Hwy 35 N., East Dubuque, Illinois / Mayor Welp, City Manager Barklow

• 
  City Manager Barklow: Mr. Naab has applied and was granted a liquor license at the last council meeting. He is now applying for a gaming license for the establishment. He plans to have 5 machines in operation.

  Motion made by Alderman Degenhardt to Approve Video Gaming License for Rosy’s Inc. at 1705 Hwy 35 N., East Dubuque, Illinois, seconded by Alderman Digman; four ayes, motion carries.
  

10. 17-0808 Discussion and Possible Action to Enter into Intergovernmental Cooperation Agreement CodeRED Emergency Notification System and Authorize Payment / Mayor Welp, City Manager Barklow

  City Manager Barklow: The city has been a part of the CodeRED Emergency Notification System for many years. Recommends the Council continue and to approve.

11. 17-0809 Discussion and Possible Action to Approve Class C Liquor License for McBerns Enterprises Inc. at 285 5^th Street, East Dubuque, IL 61025 / Mayor Welp, City Manager Barklow

  City Manager Barklow: Midtown Marina has changed ownership. Recommends the Council approve.

  Motion made by Alderman Arling to Approve Class C Liquor License for McBerns Enterprises Inc. at 285 5^th Street, East Dubuque, IL, seconded by Alderman Robey; four ayes, motion carries.
  

12. 17-0810 Discussion and Possible Action to Proceed with Close Out and Final Pay Request for East Dubuque City Hall Drainage Project / Mayor Welp, City Manager Barklow, WHKS

• 
  City Manager Barklow: This is the last phase to finally close out the project and make the final payment for work performed on the St. Mary’s Drainage project.
  
• 
  Mark Fluhr: Was disappointed with the seeding on the hill.
  
• 
  Alderman Arling: Would like to see Mark reach out about the grass seed.
  
• 
  Mayor Welp: There was quite a bit of nasty rain storms during the seeding time.

13. 17-0811 Discussion and Possible Action to Approve Request from East Dubuque Fire Department to Hold an MDA Fill the Boot Fund Raiser on Friday, August 18, 2017 from 3 p.m. to 5 p.m. at the Intersection of Sinsinawa Avenue and Wisconsin Avenue / Mayor Welp, City Manager Barklow, Fire Department

  City Manager Barklow: This is an annual fundraiser that goes to a good cause. Recommends the Council approve.

  Motion made by Alderman Degenhardt to Approve Request from East Dubuque Fire Department to Hold an MDA Fill the Boot Fund Raiser on Friday, August 18, 2017 from 3 p.m. to 5 p.m. at the Intersection of Sinsinawa Avenue and Wisconsin Avenue, seconded by Alderman Arling; four ayes, motion carries.
  

14. 17-0812 Discussion and Possible Action to Approve Class C Liquor License for Wayne Stewart, Golden Pheasant Club at 280 Sinsinawa Avenue, East Dubuque, Illinois / Mayor Welp, City Manager Barklow, Wayne Stewart

  City Manager Barklow: Mr. Stewart has submitted his application but has not been fingerprinted as the machine at the Police Department is currently down. He has also not provided insurance details.

  Alderman Robey: Feels that this should not be approved until all of the requirements are met. This was just an agenda item that was tabled twice before because the applicant had an incomplete application.
  
• 
  Alderman Arling: Would approve the license contingent upon completion of the required fingerprinting as well as the insurance information being submitted. Mr. Stewart is a resident in East Dubuque, not Freeport or somewhere else and is easy enough to find to obtain these things.

15. 17-0813 Discussion and Possible Action to Approve Video Gaming License for Wayne Stewart, Golden Pheasant Club at 280 Sinsinawa Avenue, East Dubuque, Illinois / Mayor Welp, City Manager Barklow, Wayne Stewart

  City Manager Barklow: Mr. Stewart has gone to Freeport and passed the criminal background check and has performed the fingerprinting through their office. He has met all the requirements to possess this license if allowed by Council.

16. 17-0814 Discussion and Possible Action to Authorize and Approve Agreement(s) for Professional Services with Community Funding & Planning Services for Submittal and Administration of Grant Applications for CDBG and IEPA Grant(s) for WWTF Improvements / Mayor Welp, City Manager Barklow

• 
  City Manager Barklow: Meeting with Sharon Peppin and Fehr Graham this coming Friday in regards to different routes to take to obtain grants and find a more cost effective way fund the Waste Water Treatment Project. Miss Peppin will be exploring loan forgiveness as well as applying for grants to help fund this project. It is important to get the ball rolling on this because of time restraints with grant submissions and available monies. Would like to have a decision made no later than the next Council Meeting. The WWT Facility has just been paid off so the City now owns it completely, but it is in much need of renovation and major overhaul. Just to maintain it as it sits is not energy efficient as the cost in the last 2 years for maintenance was over $54K and the electricity bills were over $113K.

17. 17-0815 Staff Reports: City Manager Report, Mayor Report, and Alderman Report

  City Manager Report-
  
  • 
    Mr. Welu has taken out a building permit to add storage units to an existing facility at a cost of $75,000. One of the requirements for the permit was a written agreement, signed by Dave Welu and Walter Bonnet, detailing erosion control methods that will be put in place.
    
  • 
    There was a complaint by Merlin Sadler regarding damage to the curb and gutter due to the heavy rainfall on 7/21/17. The Public Works Department will look at it and advise.
    
  • 
    A special council meeting was held on 7/24/17 to address the liquor and gaming license applications from Jesse 69 Inc. These were approved.
    
  • 
    Tree removal was concluded for the year on 8/4/17
    
  • 
    A building permit was taken out by Harold Middendorf Construction to build a new side by side condo unit on Timmerman Drive.
    
  • 
    TH Media would like to create a marketing piece for the City to send to prospective businesses. This would be of no cost to the city, he would like to get testimonials from existing businesses and sell ads in it.

    Alderman Degenhardt: People on Hill Street have been asking when the road will be repaired. Mark Fluhr: When we can.

    Alderman Arling: Looking into the laws regarding Adult Entertainment. Believes that there are special use permits regarding the fact that the Park has no visibility to the dwellings downtown. This could be a good money maker for the City with Sin tax and the recent addition of the gaming.
