2. If the person designated in section 64 has died, his parents, his children and his surviving spouse
may file the complaint, unless there is evidence that the deceased did not wish prosecution of the
matter.
3. In the case of a complaint of the person designated in section 64 against the legal representative
in civil matters: the spouse and a relative by consanguinity in the direct line of descent or, if all
these persons do not exist, a brother and a sister, may file such complaint.
4. If a person designated in subsections (2) and (3) has not yet reached the age of sixteen years or
has been placed under guardianship for reasons other than prodigality, or is suffering from mental
disease or defect to such an extent as to be incapable of deciding for himself whether it is in his
interest to file a complaint, criminal proceedings may be instituted upon the filing of a complaint by
his legal representative in civil matters.
