ADMINISTRATIVE LAW JUDGE’S RULING
REGARDING FILING DATES
This ruling clarifies the filing deadlines pertaining to 1) the motion of MCI WorldCom, Inc. (MCI WorldCom) and Sprint Corporation (Sprint) in this proceeding for exemption from Public Utilities Code Sections 854(a) and (b) (Motion); and 2) protests or responses to MCI WorldCom/Sprint’s application (Application).
Motion
On December 29, 1999, I extended the time to respond to the Motion to January 5, 2000. In addition, I granted an oral request by the Attorney General’s office of the State of California to file a response to the Motion no later than January 6, 2000. On January 7, 2000, I granted an oral request by MCI WorldCom to file a reply brief with regard to the Motion on January 18, 2000. I have other requests to file late responses to the Motion, which I have not ruled on. I have asked the parties making those requests to seek leave for late filing in their responses to the Motion; I will rule on late filing concurrently with my ruling on the Motion itself. Any party wishing to file a response to the Motion shall accompany their response with a motion for leave to file the response belatedly.
Protest Period
On January 10, 2000, I received a request from The Utility Reform Network to extend the protest period for the Application to January 28, 2000. I granted that request. Any party wishing to protest or respond to the Application may do so on or before January 28, 2000.
Therefore, IT IS RULED that:
-
Responses to the Motion of MCI WorldCom and Sprint For Early Determination Of Exemption From Public Utilities Code Sections 854(b) and (c) (Motion) were due on January 6, 2000. Any party seeking additional time to respond to the Motion shall file and serve a written request for such time with their response.
-
MCI/WorldCom and Sprint may file and serve a reply brief in support of their Motion on or before January 18, 2000.
-
The protest period on the Application of MCI WorldCom and Sprint for Approval to Transfer Control of Sprint Corporation’s California Operating Subsidiaries is extended to January 28, 2000.
