Section 363 
1.  Any civil servant who: 
1°.  accepts a gift or promise or service, knowing or reasonably suspecting that it is given, made or 
rendered to him in order to induce him to act or to refrain from certain acts in the performance 
of his office, in violation of his duty;  
2°.  accepts a gift or promise or service, knowing or reasonably suspecting that it is given, made or 
rendered to him as a result or as a consequence of certain acts he has undertaken or has 
refrained from undertaking in the performance of his current or former office, in violation of his 
duty;  
3°.  requests a gift, promise or service in order to induce him to act or to refrain from certain acts in 
the performance of his office, in violation of his duty;  
4°.  requests a gift, promise or service, as a result or as a consequence of certain acts he has 
undertaken or has refrained from undertaking in the performance of his current or former office, 
in violation of his duty;  
 
shall be liable to a term of imprisonment not exceeding four years or a fine of the fifth category. 
 
2.  Any person who, in anticipation of an appointment as civil servant, commits an offence as defined 
in subsection (1)(1°) and (3°), shall, if the appointment as civil servant follows, be liable to the 
same punishment.  
3.  Any person who commits an offence as defined in subsection (1) in connection with his capacity as 
minister, state secretary, royal commissioner, member of the provincial executive, mayor, member 
of the municipal executive or member of a general representative body, shall be liable to a term of 
imprisonment not exceeding six years or a fine of the fifth category.
