MINUTES OF THE REGULAR MEETING OF THE EMERY COUNTY SPECIAL SERVICE DISTRICT #1

March 9, 2015

DISCUSSION OF ADOPTING NEW PURCHASING POLICY
A motion was made by Merrill Swasey to table this item. The motion was seconded by Dean King and approved by all members present.

UPDATE ON NON-URBAN JOINT HIGHWAY COMMITTEE AWARD FROM STATE PARKS ACCESS FUNDS FOR MILLSITE/GOBLIN VALLEY CHIP SEAL
Kent Petersen accompanied Merrial Johansen, Johansen and Tuttle Engineering, to the Non-Urban Joint Highway Committee meeting in Richfield, Utah to request a 50/50 grant to chip seal the Millsite and Goblin Valley State Park Access Roads which the district recently upgraded. The county was awarded $500,000 which will be available in 2019 out of fiscal year 2020 funding. The total cost of the project will be $1,000,000.

UPDATE OF CURRENT PROJECTS
South Moore Phase 10 - County Road 803
The bid for this project will be opened tomorrow. Howard Tuttle made the comment that he was told that if Nielson Construction was the low bidder, they might request a delay in starting the project. They have lined up quite a few projects to begin this spring.

SITLA ROW Acquisition - B Roads
Mike Olsen, Emery County Attorney, was unable to attend the meeting, therefore, this item will be carried forward to the next meeting for discussion.
Cleveland South Flat Bus Route - County Road 201
Howard Tuttle reported that he attended the county commission meeting and requested that the commissioners approve to request Rocky Mountain Power, by motion - followed up by letter and copy of the meeting minutes, to re-locate power poles on this project through the franchise held by Emery County.
Emery Telcom and North Emery Water User’s Special Service District utility lines will need to be relocated. Historically, the district has worked with Emery Telcom to accomplish the relocation of their lines, i.e. dig the trench while Emery Telcom lays the line, etc. and has ended up relocating NEWusers SSD water lines. The district does not pay for upgrades.
After discussion, a motion was made by Richard Jensen to authorize Howard Tuttle/Bevan Wilson, project manager, to negotiate with Emery Telcom and North Emery Water Users Special Service District to have both companies participate in relocating their respective lines.
All the land rights-of-way (ROW) are in the process of being signed by the landowners.
There was a discussion on the building located in the ROW of the next phase of the project.
Howard Tuttle asked permission to get bids from Harper and New Castle for the concrete box which is required for this project. When the district purchases the box direct it saves tax and markup by the contractor. A motion was made by Merrill Swasey to allow Howard Tuttle to bid the concrete box. The motion was seconded by Richard Jensen and approved by all members present.

Goblin Valley/Temple Mountain Road Fencing Project
The new cost estimate of this project, prepared by Howard Tuttle, after last meeting discussion was $300,000-350,000. The information of the new estimate did not get passed along. Misti Christainsen approached Senator David Hinkins and told him the fence could be built for $135,000. Senator Hinkins secured that amount through the legislature. This amount did not include cattle guards, permits, or state specifications of the fence. The district cannot build this fence for $135,000. It is uncertain if this fence will be built by another entity.

APPROVAL OF BILLS AND FINANCIAL REPORT
The bills and the financial report were approved on a motion by Dean King and a second by Merrill Swasey. The motion was approved by all members present.
The 2015 fiscal year 3rd qtr. (January 2015) mineral lease allocation (through UDOT) will be $173,956.29 as follows:

Emery County Special Service District #1 $ 69,582.52

Local Building Authority of Emery County $ 50,447.33

Castle Valley Special Service District $ 22,614.32

Emery County Recreation Special Service District $ 13,916.50

Emery County Fire Protection Special Service District $ 13,916.50

North Emery Water Users Special Service District $ 3,479.12
Total $ 173,956.29
A motion to ratify the January 2015 distribution of MMS revenue through UDOT was made by Richard Jensen. Merrill Swasey seconded the motion and the motion was approved by all members present.
The district received a check in the amount of $6,156.93 from Secure Rural Schools.

The minutes for 2/9/2015 were approved on a motion by Dean King and a second by Merrill Swasey. The motion was approved by all members present.

OTHER BUSINESS
Commissioner Cowley asked if the board would look at Lundy Lane, north end of the county, as a possible project in the future.

ADJOURNMENT
The meeting was adjourned as the agenda came to the end. The next meeting is scheduled for April 13, 2015.
