LEGAL BASIS FOR THE PROTECTION OF THE RIGHTS OF THE CHILD

In any democratic state governed by the rule of law and civil society, special attention is paid to the protection of human and civil rights in the first place. It should be noted that in most cases, human rights and civil rights refer to the adult population, while children are ignored. We would like to discuss the issues related to children's rights below.
In the Republic of Uzbekistan, all citizens are subjects of legal relations. We know that "a subject of legal relations is a person who has the rights and obligations established by law." [1]
In addition to protecting the legitimate rights and interests of other segments of the population, the state pays special attention to the protection and promotion of the rights of minors. Based on the content of Article 1 of the UN Convention on the Rights of the Child, Articles 22, 27, 29 of the Civil Code of the Republic of Uzbekistan, [2] Article 71 of the Family Code [3], 18 a minor is a child (except in cases of emancipation).
A person is born with certain rights. But it will take a long time for a breastfed baby to be able to defend its rights. During this time, his rights will need to be protected by law. Therefore, in the system of international law there is an area called "children's rights", which covers the rights, privileges and guarantees of physically and mentally immature children, including children in need of special attention and care. This area, which is an integral part of human rights, has come a long way.
Today, in a situation where political tensions and socio-economic instability have been going on in different parts of the world for a long time, if we think more deeply about the fate and future of children there, how important is the protection of children's rights in the world? it becomes clear once again.
“Guarantees for the protection of children's rights are becoming stronger in our country. It creates all the conditions for the children of Uzbekistan to grow up physically and spiritually, to receive education and upbringing at the level of world standards, to achieve their dreams and goals. ”[4]
All this is in harmony with the noble intentions, aspirations and goals of our people, and serves the development of our children as a healthy and free-thinking generation.
In our country, which is on the path of building a free civil society, "Year of Human Interests", "Year of Family", "Year of Women", "Year of Healthy Generation", "Year of Mothers and Children", "Year of Mercy and Compassion", "Health The Year of Health "," Year of Patrons and Doctors "," Year of Social Protection "," Year of Youth "," Year of harmoniously developed generation "are being implemented in a comprehensive package of measures. As President Islam Karimov noted, "... the future of our people depends on the education and upbringing of our children today." [5] At the same time, Uzbekistan is among the CIS countries in the successful implementation of these measures. leading.
The child has the right from birth. In his speech at the IX session of the Oliy Majlis of the Republic of Uzbekistan, the first President Islam Karimov said: , is to make a home, ”[6]. If a child is not physically and mentally mature, he or she will need special protection and care, and therefore adequate legal protection before and after birth.
As stated in Article 1 of the Convention on the Rights of the Child, “Any person under the age of 18 shall, under the law applicable to a child, be entitled to a minimum of ten years of age. is a child. ”[7]
“All the rights of every child, regardless of race, race, body color, sex, language, religion, political or other beliefs, national or ethnic origin, the child's health and upbringing. He should be respected and his rights should be respected, regardless of his mother or legal guardian or any other circumstances. ”[8]
In order to fully implement the requirements of the Convention on the Rights of the Child, to ensure in practice the rights of children provided for in the Constitution and laws of the Republic of Uzbekistan, to ensure their physical, intellectual, spiritual and spiritual development, as well as In order to ensure the current implementation of the five priorities of the development of the Republic of Uzbekistan in 2017-2021, on April 22, 2019 "On additional measures to further strengthen the guarantees of the rights of the child" [9] The presidential decree was announced. It is no exaggeration to say that this decision has opened the door to new opportunities to ensure and guarantee the rights of the child.
