what types of work equipment will be used and how 
this will be handled

how the work and processes involved are organized

the need to assess and provide health and safety

risks from the particular agents, processes and work.
17.22.14 Provisions as to liability – Regulation 21
This provision is to prevent a defense for an employer by 
reason of any act or default by an employee or a com-
petent person appointed under Regulation 7. Employees 
duties to take reasonable care of their own health and 
safety and that of others affected by their work activities 
is unaffected by this provision.

Restriction of Civil Liability for Breach 
of Statutory Duty Regulation 22
By the 2003 Amendment Regulations (SI 2003 No 2457) 
Regulation 22 was changed from an exclusion of civil 
liability to the following;
Breach of a duty imposed on an employer by these 
Regulations shall not confer a right of action in any civil 
proceedings insofar as that duty applies for the protec-
tion of persons not in their employment.
