Procedures during an eTrial 
26. 
Prior to an eTrial commencing, the Court will upload all submitted 
items into ICMS, for the associate to the trial judge to manage 
throughout the eTrial.

During the eTrial, the associate will open submitted items from ICMS 
and project them onto the Court's display screens as required. The item 
will then simultaneously display on the Court screens, the judge's 
screen, the associate's screen and any screens on the bar table that are 
being used.

When a submitted item is tendered, the associate will identify the item 
as either:

(a)
marked for identification; or 
(b)
an exhibit.

ICMS is an internal court system and is not able to be accessed by the 
parties. If requested by a party, the associate will print for the parties a 
report from ICMS of all the items tendered as either 'marked for 
identification' or an 'exhibit', either to date or for a particular day of trial. 
The parties should inform the associate of any items that are incorrectly 
included or absent from the report.

Parties may view all items in the electronic trial bundle via the ECMS 
(eCourts Portal). There is a link to the submitted items on the 'hearings' 
screen for the particular matter. Each item will be identified as being 
either: 
(a)
a submitted item; 
(b)
marked for identification; or 
(c)
an exhibit.

The effective management of the trial requires that the parties use the 
same index and numbering system so that submitted items can be 
searched for and retrieved quickly. The hyperlinked index and 
document folder created for the electronic trial bundle may be sufficient 
for this purpose, however where parties seek to annotate items or 
manage them in accordance with the practice of their law firm then they 
should consider creating their own databases.
