Consolidated practice directions

Order 19 of the Rules provides for the issuing of third party notices.

The purpose of this Practice Direction is to clarify the requirements for 
filing and issuing third party notices, and, in particular, requirements 
where the defendant claims against multiple persons not already a party 
to the action.

O 19 r1(1) provides that a defendant who has entered an appearance in 
any action may issue a third party notice against a person not already a 
party to the action, if the defendant claims 
–
(a)
that they are entitled to contribution or indemnity; or 
(b)
that they are entitled to any relief or remedy relating to or 
connected with the original subject matter of the action and 
substantially the same as some relief or remedy claimed by the 
plaintiff; or 
(c)
that any question or issue relating to or connected with the original 
subject matter of the action is substantially the same as some 
question or issue arising between the plaintiff and the defendant 
and should properly be determined not only as between the 
plaintiff and the defendant but also as between either or both of 
them and the third party.

A defendant must have leave of the Court to issue a third party notice, 
unless the notice is issued before the defence is served on the plaintiff: 
O 19 r 1(2). 
5.
The notice must contain a statement of the nature of the claim made 
against the third party and, as the case may be, either of the nature and 
grounds of the claim made by the defendant or of the question or issue 
required to be determined.

Where the defendant intends to initiate third party proceedings in 
respect to multiple persons, ordinarily, a separate third party notice 
must be filed in respect of each person the defendant claims against. 
7.
Separate third party notices are not required where the nature of the 
claim made against each proposed third party and, as the case may be, 
either of the nature and grounds of the claim made by the defendant or 
of the question or issue required to be determine, are the same as against
